| 1 | AN ACT concerning domestic violence.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the | |||||||||||||||||||
| 5 | Domestic Violence Task Force Act. | |||||||||||||||||||
| 6 | Section 5. Public policy.
The purpose of this Act is to | |||||||||||||||||||
| 7 | establish a consistent, uniform statewide system to protect | |||||||||||||||||||
| 8 | victims and survivors of domestic violence, while holding | |||||||||||||||||||
| 9 | offenders accountable. | |||||||||||||||||||
| 10 | Section 10. Task Force; creation. The Domestic Violence | |||||||||||||||||||
| 11 | Task Force is created. The Task Force shall: | |||||||||||||||||||
| 12 | (1) conduct a comprehensive review of the process, | |||||||||||||||||||
| 13 | operation, and enforcement of current domestic violence laws | |||||||||||||||||||
| 14 | across the State; | |||||||||||||||||||
| 15 | (2) identify gaps in the process, operation, and | |||||||||||||||||||
| 16 | enforcement of those laws; | |||||||||||||||||||
| 17 | (3) develop recommendations to address those gaps; | |||||||||||||||||||
| 18 | (4) establish a framework for specialized protective | |||||||||||||||||||
| 19 | networks for victims, treatment options for victims and | |||||||||||||||||||
| 20 | offenders, and specialty courts for the accumulation of | |||||||||||||||||||
| 21 | specialized domestic violence skills for courts; and
| |||||||||||||||||||
| 22 | (5) review the need for special consideration for | |||||||||||||||||||
| |||||||
| |||||||
| 1 | conditions of bail in cases involving domestic violence within | ||||||
| 2 | the ongoing changes brought on by bail reform.
| ||||||
| 3 | Section 15. Task Force membership. | ||||||
| 4 | (a) The Domestic Violence Task Force shall be composed of | ||||||
| 5 | the following members: | ||||||
| 6 | (1) 2 judges appointed by the Illinois Supreme Court, | ||||||
| 7 | at least one of whom shall have experience with domestic | ||||||
| 8 | violence cases; | ||||||
| 9 | (2) the Director of the Administrative Office of the | ||||||
| 10 | Illinois Courts or the Director's designee; | ||||||
| 11 | (3) one probation officer appointed by the Chief | ||||||
| 12 | Justice of the Illinois Supreme Court who has significant | ||||||
| 13 | experience with domestic violence cases; | ||||||
| 14 | (4) the Attorney General, or the Attorney General's | ||||||
| 15 | designee; | ||||||
| 16 | (5) the Director of the Illinois Criminal Justice | ||||||
| 17 | Information Authority, or the Director's designee; | ||||||
| 18 | (6) the following public members appointed by the | ||||||
| 19 | Governor: | ||||||
| 20 | (A) 2 members representing victims' rights | ||||||
| 21 | organizations; | ||||||
| 22 | (B) 2 members representing State's Attorneys based | ||||||
| 23 | on recommendations from the Illinois State's Attorneys | ||||||
| 24 | Association, both of which shall have experience with | ||||||
| 25 | domestic violence cases; | ||||||

| |||||||
| 1 | (C) 2 members representing law enforcement, both | ||||||
| 2 | of which shall have experience with domestic violence | ||||||
| 3 | cases; and | ||||||
| 4 | (D) one member representing family law lawyers who | ||||||
| 5 | shall have experience with domestic violence cases | ||||||
| 6 | based on a recommendation from a statewide bar | ||||||
| 7 | association; and | ||||||
| 8 | (7) the Director of the Illinois State Police, or the | ||||||
| 9 | Director's designee; | ||||||
| 10 | (8) the Secretary of Human Services or the Secretary's | ||||||
| 11 | designee; | ||||||
| 12 | (9) one Representative appointed by the Speaker of the | ||||||
| 13 | House of Representatives; | ||||||
| 14 | (10) one Representative appointed by the Minority | ||||||
| 15 | Leader of the House of Representatives; | ||||||
| 16 | (11) one Senator appointed by the President of the | ||||||
| 17 | Senate; | ||||||
| 18 | (12) one Senator appointed by the Minority Leader of | ||||||
| 19 | the Senate; | ||||||
| 20 | (13) 4 members who are survivors of domestic violence, | ||||||
| 21 | one appointed
by the Speaker of the House of | ||||||
| 22 | Representatives, one appointed by the Minority Leader of | ||||||
| 23 | the House of
Representatives, one appointed by the | ||||||
| 24 | President of the
Senate, and one appointed by the Minority | ||||||
| 25 | Leader of the
Senate; and | ||||||
| 26 | (14) one member who is a survivor of domestic | ||||||
| |||||||
| |||||||
| 1 | violence, appointed by the
Governor.
| ||||||
| 2 | (b) The designated appointing authority listed in | ||||||
| 3 | subsection (a) shall have the authority to replace any of the | ||||||
| 4 | authority's appointed members.
| ||||||
| 5 | (c) The Chair of the Task Force shall be selected by a | ||||||
| 6 | majority vote of the members of the Task Force. | ||||||
| 7 | (d) Task Force members shall not be compensated for their | ||||||
| 8 | service on the Task Force. | ||||||
| 9 | Section 20. Administrative support and duties.
| ||||||
| 10 | (a) The Family Violence Coordinating Council within the | ||||||
| 11 | Illinois Criminal Justice Information Authority shall provide | ||||||
| 12 | administrative support to the Task Force. | ||||||
| 13 | (b) The Task Force shall review available research, best | ||||||
| 14 | practices, and effective interventions to formulate | ||||||
| 15 | recommendations. | ||||||
| 16 | (c) The Task Force shall produce a report detailing the | ||||||
| 17 | Task Force's findings and making recommendations. The Task | ||||||
| 18 | Force shall submit a report of its findings and | ||||||
| 19 | recommendations to the General Assembly and the Governor on or | ||||||
| 20 | before September 1, 2022.
| ||||||
| 21 | Section 25. Repeal. This Act is repealed on September 1, | ||||||
| 22 | 2027.
| ||||||
| 23 | Section 99. Effective date. This Act takes effect upon | ||||||
| 24 | becoming law.
