| 1 | | AN ACT concerning education.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by changing Section |
| 5 | | 10-23.13 as follows: |
| 6 | | (105 ILCS 5/10-23.13) |
| 7 | | Sec. 10-23.13. Policies addressing sexual abuse. |
| 8 | | (a) In this Section, "evidence-informed" refers to |
| 9 | | modalities that were created utilizing components of |
| 10 | | evidence-based treatments or curriculums. |
| 11 | | (b) To adopt and implement, by no later than July 1, 2022, |
| 12 | | a policy addressing sexual abuse of children that shall may |
| 13 | | include an age-appropriate and evidence-informed curriculum |
| 14 | | for students in pre-K through 12th 5th grade; |
| 15 | | evidence-informed training for school personnel on child |
| 16 | | sexual abuse; evidence-informed educational information to |
| 17 | | parents or guardians provided in the school handbook on the |
| 18 | | warning signs of a child being abused, along with any needed |
| 19 | | assistance, referral, or resource information; available |
| 20 | | counseling and resources for students affected by sexual |
| 21 | | abuse; and emotional and educational support for a child of |
| 22 | | abuse to continue to be successful in school. A school |
| 23 | | district shall include in its policy and all training |

| 1 | | materials and instruction a definition of prohibited grooming |
| 2 | | behaviors and boundary violations for school personnel and how |
| 3 | | to report these behaviors. |
| 4 | | Any policy adopted under this Section shall may address |
| 5 | | without limitation: |
| 6 | | (1) methods for increasing school personnel teacher, |
| 7 | | student, and parent awareness of issues regarding sexual |
| 8 | | abuse of children, including awareness and knowledge of |
| 9 | | likely warning signs indicating that a child may be a |
| 10 | | victim of sexual abuse, awareness and knowledge of |
| 11 | | grooming behaviors and how to report those behaviors, |
| 12 | | awareness of appropriate relationships between school |
| 13 | | personnel and students based on State law, and how to |
| 14 | | prevent child abuse from happening, including, but not |
| 15 | | limited to, methods outlined in State law regarding |
| 16 | | personal health and safety education for students; |
| 17 | | (1.5) evidence-informed training for school personnel |
| 18 | | on preventing, recognizing, reporting, and responding to |
| 19 | | child sexual abuse and grooming behavior, including when |
| 20 | | the grooming or abuse is committed by a member of the |
| 21 | | school community, with a discussion of the criminal |
| 22 | | statutes addressing sexual conduct between school |
| 23 | | personnel and students, professional conduct, and |
| 24 | | reporting requirements, including, but not limited to, |
| 25 | | training as outlined in Section 10-22.39 and Section 3-11; |
| 26 | | (2) options actions that a student child who is a |

| 1 | | victim of sexual abuse has should take to obtain |
| 2 | | assistance and intervention; and |
| 3 | | (3) available counseling options for students affected |
| 4 | | by sexual abuse; . |
| 5 | | (4) methods for educating school personnel, students, |
| 6 | | and staff on how to report child abuse to law enforcement |
| 7 | | authorities and to the Department of Children and Family |
| 8 | | Services and how to report grooming behaviors, including |
| 9 | | when the grooming or abuse is committed by a member of the |
| 10 | | school community; and |
| 11 | | (5) education and information about children's |
| 12 | | advocacy centers and sexual assault crisis centers and |
| 13 | | information about how to access a children's advocacy |
| 14 | | center or sexual assault crisis center serving the |
| 15 | | district. |
| 16 | | (c) A school district must provide training for school |
| 17 | | personnel on child sexual abuse as described in paragraph |
| 18 | | (1.5) of subsection (b) no later than January 31 of each year. |
| 19 | | (d) This Section may be referred to as Erin's Law.

| 21 | | Section 99. Effective date. This Act takes effect upon |
| 22 | | becoming law.
