| 2 | | AMENDMENT NO. ______. Amend House Bill 3583 on page 1, by |
| 3 | | replacing lines 8 through 12 with the following:

| 4 | | ""Eligible prescription drug" means a prescription drug or |
| 5 | | biological product, as defined in 42 U.S.C. 262(i), that is |
| 6 | | not under patent. |
| 7 | | "Generic prescription drug" means a drug that is approved |
| 8 | | pursuant to an application referencing an eligible |
| 9 | | prescription drug that is submitted under subsection (j) of |
| 10 | | Section 505 of the federal Food, Drug, and Cosmetic Act (21 |
| 11 | | U.S.C. 355(j)) or under subsection (k) of Section 351 of the |
| 12 | | federal Public Health Service Act (42 U.S.C. 262(k)).".
