| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Banking Act is amended by adding |
| 5 | | Section 45.2 as follows:
|
| 6 | | (205 ILCS 5/45.2 new) |
| 7 | | Sec. 45.2. Overdraft fees during the COVID-19 pandemic. A |
| 8 | | bank shall not charge overdraft fees on accounts during a |
| 9 | | public health emergency caused by the COVID-19 pandemic.

| 10 | | Section 10. The Savings Bank Act is amended by adding |
| 11 | | Section 7009 as follows:

| 13 | | Sec. 7009. Overdraft fees during the COVID-19 pandemic. A |
| 14 | | savings bank shall not charge overdraft fees on deposit |
| 15 | | accounts during a public health emergency caused by the |
| 16 | | COVID-19 pandemic.
