AMENDMENT TO HOUSE BILL 3850

AMENDMENT NO. ______. Amend House Bill 3850 on page 3 by replacing line 12 through line 13 with the following:

"allows the defendant, with her or his agreement with the consent of the prosecution, to enter the drug court program"; and

on page 6, line 14, by replacing "shall" with "shall"; and

on page 6, line 16, by replacing "shall" with "may shall"; and

on page 8, line 14, by replacing "convicted" with "charged"; and

on page 10, by replacing line 19 through line 22 with the following:

"substance use disorder or mental health treatment, comply with abuse treatment in an outpatient, inpatient, residential, or jail-based custodial treatment program"; and

on page 21, by inserting the following immediately above line 20:

"Recognizing that the term "mentor" is aligned with other veteran services and programs, and recognizing that a mentor may foster closer rapport than a coach, peer recovery coaches and peer mentors may be considered distinctly different roles while operating in accordance with Supreme Court Standards, and the court's policies and procedures."; and

on page 21, by replacing line 21 through line 23 with the following:

"Program" means a program that allows the defendant, with her or his agreement, to enter the program before plea, conviction, or disposition, and"; and

on page 24, by replacing line 12 through line 13 with the following:

"programs in accordance with the nationally recommended 10 Key Components of Veteran Treatment courts and Illinois Supreme Court"; and

on page 26, line 8, by deleting "shall"; and

on page 26, line 10, by replacing "shall" with "may"; and

on page 28, line 11, by replacing "convicted" with "charged convicted"; and

on page 28, line 16, by replacing "drug court" with "Veteran and Servicemembers Court"; and

on page 29, by replacing line 13 with the following:

"defendant shall be performed as by the VA, VAC, or by the IDVA "; and

on page 29, by replacing line 16 through line 19 with the following:

"include, but is not limited to, a validated clinical assessment, mental health and substance use disorder screening and assessment and shall be administered by a qualified"; and

on page 31, by replacing line 1 through line 4 with the following:

"substance use disorder or mental health treatment abuse treatment in an outpatient, inpatient, residential, or jail-based custodial treatment program, order the defendant to complete mental health counseling in an inpatient or outpatient basis, comply with"; and

on page 38, by replacing line 10 with the following:

"processes, limited English proficiency, team dynamics, and military culture."; and

on page 38, by replacing line 23 with the following:

"processes, limited English proficiency, team dynamics, and military culture."; and

on page 41, by replacing line 15 through line 16 with the following:

"program that allows the defendant, with his or her agreement, the consent of the prosecution, to enter the drug court"; and

on page 44, line 14, by deleting "shall"; and

on page 44, line 16, by replacing "shall" with "may"; and

on page 49, by replacing line 6 through line 9 with the following:

"mental health or substance use disorder abuse treatment, comply in an outpatient, inpatient, residential, or jail-based custodial treatment program".
