| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Decennial Committees on Local Government |
| 5 | | Efficiency Act is amended by changing Sections 5, 10, 20, and |
| 6 | | 25 as follows: |

| 8 | | Sec. 5. Definitions Definition. As used in this Act: , |
| 9 | | "Governing board" means the governing body of a |
| 10 | | governmental unit. If the governmental unit is a road |
| 11 | | district, then "governing board" means the governing body of |
| 12 | | the road district, as provided in Division 1 of Article 6 of |
| 13 | | the Illinois Highway Code, including, but not limited to, the |
| 14 | | highway board of auditors, the highway commissioner of a |
| 15 | | township road district, the township board of trustees, the |
| 16 | | city council, the municipal president and board of trustees, |
|

| 1 | | or the county board, as applicable. |
| 2 | | "Governmental unit" means all entities that levy taxes and |
| 3 | | are also units of local government, as defined in Section 1 of |
| 4 | | Article VII of the Illinois Constitution, governmental unit" |
| 5 | | includes all units of local government that may levy any tax, |
| 6 | | except municipalities and counties.

| 9 | | Sec. 10. Formation of committee; members; vacancy; |
| 10 | | administrative support.
|
| 11 | | (a) By June 10, 2023 ( Within one year after the effective |
| 12 | | date of this Act) and at least once every 10 years after June |
| 13 | | 10, 2023 thereafter, each governmental unit must form a |
| 14 | | committee to study local efficiencies and report |
| 15 | | recommendations regarding efficiencies and increased |
| 16 | | accountability to the county board in which the governmental |
| 17 | | unit is located. |
| 18 | | (b) Each committee's membership shall include the elected |
| 19 | | or appointed members of the governing board of the |
| 20 | | governmental unit; at least 2 residents within the territory |
| 21 | | served by of the governmental unit, who are appointed by the |
| 22 | | chair of the governing board of the governmental unit, with |
| 23 | | the advice and consent of the governing board; and any chief |
| 24 | | executive officer or other officer of the governmental unit. |
| 25 | | The committee shall be chaired by the president or chief |

| 1 | | elected or appointed official of the governing board of the |
| 2 | | governmental unit, or his or her designee. The chairperson may |
| 3 | | appoint additional members to the committee as the chairperson |
| 4 | | he or she deems appropriate. |
| 5 | | Committee members shall serve without compensation but may |
| 6 | | be reimbursed by the governmental unit for their expenses |
| 7 | | incurred in performing their duties. |
| 8 | | (b-5) In lieu of the committee described in subsection |
| 9 | | (a), a highway commissioner of a township road district in a |
| 10 | | county with a population under 400,000 and the township board |
| 11 | | of the same township may form a joint committee for the |
| 12 | | purposes described in subsection (a). That joint committee |
| 13 | | shall include: the township trustees; the highway |
| 14 | | commissioner; at least 2 residents of the territory served by |
| 15 | | the governmental unit appointed by the township supervisor |
| 16 | | with the advice and consent of the township board; at least one |
| 17 | | resident of the governmental unit appointed by the highway |
| 18 | | commissioner; and the township supervisor. The joint committee |
| 19 | | shall be chaired by the township supervisor and shall issue a |
| 20 | | joint report with 2 sections, one section for the township and |
| 21 | | one section for the road district. Except with respect to its |
| 22 | | composition and report, the joint committee shall otherwise |
| 23 | | comply with subsection (b). References in this Act to a |
| 24 | | "committee" shall also include a joint committee formed under |
| 25 | | this subsection. |
| 26 | | (c) A committee may employ or use the services of |
|

| 1 | | specialists in public administration and governmental |
| 2 | | management and any other trained consultants, analysts, |
| 3 | | investigators, and assistants it considers appropriate, and it |
| 4 | | may seek assistance from community colleges and universities |
| 5 | | as necessary to prepare the report required under Section 25. |
| 6 | | (d) If a vacancy occurs in the committee membership, the |
| 7 | | vacancy shall be filled in the same manner as the appointments |
| 8 | | under subsection (b). |
| 9 | | (e) Each governmental unit shall provide administrative |
| 10 | | and other support to its committee.

| 13 | | Sec. 20. Meetings. Each committee shall meet at least 3 |
| 14 | | times. The committee may meet during a regularly scheduled |
| 15 | | meeting of the governmental unit as long as: (1) separate |
| 16 | | notice is given in conformance with the Open Meetings Act; (2) |
| 17 | | the committee meeting is listed as part of the governing |
| 18 | | board's board of the governmental unit's agenda; and (3) at |
| 19 | | least a majority of the members of the committee are present at |
| 20 | | the committee's meeting. Each meeting of the committee shall |
| 21 | | be public, and the committee shall provide an opportunity for |
| 22 | | any person to be heard at the public hearings for at least 3 |
| 23 | | minutes. The committee may require speakers to register. The |
| 24 | | committee shall meet in accordance with the Open Meetings Act, |
| 25 | | and the committee shall be a public body to which the Freedom |

| 1 | | of Information Act applies. |
| 2 | | At the conclusion of each meeting, the committee shall |
| 3 | | conduct a survey of residents who attended asking for input on |
| 4 | | the matters discussed at the meeting. A survey conducted via
|
| 5 | | email to all residents who attended the meeting and provided a
|
| 6 | | valid email address will be sufficient to satisfy the
|
| 7 | | requirements of this paragraph.

| 10 | | Sec. 25. Report. Each committee shall summarize its work |
| 11 | | and findings within a written report, which shall include |
| 12 | | recommendations in respect to increased accountability and |
| 13 | | efficiency, and shall provide the report to the administrative |
| 14 | | office of each county board in which the governmental unit is |
| 15 | | located no later than 18 months after the formation of the |
| 16 | | committee. The report shall be made available to the public.

| 17 | | For purposes of this Section, if a governmental unit is
|
| 18 | | located in multiple counties, the committee may, if required, |
| 19 | | provide the
same report to the county board of each of those |
| 20 | | counties. |

| 22 | | Section 10. The State Mandates Act is amended by adding |
| 23 | | Section 8.47 as follows: |
