AMENDMENT TO HOUSE BILL 4268

AMENDMENT NO. ______. Amend House Bill 4268 on page 4, line 14, by replacing "sole" with "primary"; and

on page 5, line 18, after "credits.", by inserting "A contract may be subject to change orders in the ordinary course of a construction project but may not be amended to include projects not originally included in the request for proposals required by Section 19b-1.4 of this Code."; and

on page 7, lines 5 and 6, by replacing "Proposals submitted shall be sealed." with "Proposals submitted shall be sealed."; and

on page 8, line 17, by replacing "sealed" with "sealed"; and

on page 9, line 20, after "conducted", by inserting "by the school board of the school district or the governing board of the area vocational center"; and

on page 10, line 13, by replacing "paragraph (1) of subsection (a)" with "subsection (b)"; and

on page 11, line 5, by deleting "the State Board of Education and"; and

on page 11, line 9, by replacing "Proposals Sealed proposals" with "Sealed proposals"; and

on page 11, lines 17 through 20, by deleting "identified by the Smart Energy Design Assistance Center (SEDAC), in consultation with the Capital Development Board, pursuant to paragraph (1) of subsection (a) of Section 19b-90 of this Code"; and

on page 12, lines 7 through 9, by replacing ", or both, within a 10-year period (or 20-year period for solar or geothermal projects)" with "for the reasonably projected payback period for the improvements, as certified by resolution of the school district or area vocational center, or 20 years, whichever is less, or both, within a 20-year period"; and

on page 12, lines 22 and 23, by replacing "a 10-year period (or 20-year period for solar or geothermal projects), 20 years" with "the reasonably projected payback period for the improvements, as certified by resolution of the school district or area vocational center, or 20 years, whichever is less, for"; and

"(a) Any contract under this Section shall utilize the template provided for such contracts through a statewide organization representing Illinois school business officials or follow the requirements in subsections (c) and (d) of this Section, at the discretion of the school district or area vocational center."; and

on page 16, line 10, by replacing "(a)" with "(b)"; and

on page 16, line 11, by deleting "is"; and

on page 16, by deleting lines 12 through 15; and

on page 16, line 16, by deleting "SEDAC"; and

on page 16, line 16, by deleting "have the"; and

on page 16, by replacing lines 17 through 21 with the following: "assist school districts and area vocational centers in compiling a list of qualified energy service providers, with respect to the review of performance contracts."; and

on page 17, line 4, by replacing "(b)" with "(c) At the request of a school district or area vocational center,"; and

on page 17, line 6, by replacing "(b)" with "(c)"; and

on page 17, line 18, by replacing "(c)" with "(d) At the request of a school district or area vocational center,"; and

on page 18, line 3, by replacing "(d)" with "(e)"; and

on page 18, line 4, by replacing "from a school district or an area vocational" with "that will, subject to appropriation, be funded by the State"; and

on page 18, by deleting lines 5 through 9.
