AMENDMENT TO HOUSE BILL 4763




2    AMENDMENT NO. ______. Amend House Bill 4763 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Assisted Living and Shared Housing Act is 
5amended  by adding Section 73 as follows:
 
6    (210 ILCS 9/73 new)
7    Sec. 73. Posting of Long Term Care Ombudsman Program 
8information.
9    (a)    Except as provided under subsection (b), all licensed 
10establishments shall post on the home page of the 
11establishment's website the following:
12        (1) The statement "The Illinois Long Term Care 
13    Ombudsman Program is a free resident advocacy service 
14    available to the public.".
15        (2)   The Long Term Care Ombudsman Program's statewide 
16    toll-free telephone number.

1        (3) A link to the Long Term Care Ombudsman Program's 
2    website.
3    (b) An establishment:
4        (1)    may comply with this Section by posting the 
5    required information on the website of the establishment's 
6    parent company if the establishment does not maintain a 
7    unique website; and
8        (2)   is not required to comply with this Section if the 
9    establishment and any parent company do not maintain a 
10    website.
 
11    Section 10. The Life Care Facilities Act is amended  by 
12adding Section 10.2 as follows:
 
13    (210 ILCS 40/10.2 new)
14    Sec. 10.2. Posting of Long Term Care Ombudsman Program 
15information.
16    (a)     Except as provided under subsection (b), all licensed 
17facilities shall post on the home page of the facility's 
18website the following:
19        (1) The statement "The Illinois Long Term Care 
20    Ombudsman Program is a free resident advocacy service 
21    available to the public.".
22        (2)   The Long Term Care Ombudsman Program's statewide 
23    toll-free telephone number.
24        (3) A link to the Long Term Care Ombudsman Program's

2    (b)   A facility:
3        (1)      may comply with this Section by posting the 
4    required information on the website of the facility's 
5    parent  company if the facility does not maintain a unique 
6    website; and

8    facility and any parent company do not maintain a website.
 
9    Section 15. The Nursing Home Care Act is amended  by adding 
10Section 3-613 as follows:
 
11    (210 ILCS 45/3-613 new)
12    Sec. 3-613. Posting of Long Term Care Ombudsman Program 
13information.
14    (a)     Except as provided under subsection (b), all licensed 
15facilities shall post on the home page of the facility's 
16website the following:
17        (1) The statement "The Illinois Long Term Care 
18    Ombudsman Program is a free resident advocacy service 
19    available to the public.".
20        (2)   The Long Term Care Ombudsman Program's statewide 
21    toll-free telephone number.
22        (3) A link to the Long Term Care Ombudsman Program's 
23    website.

1        (1) may comply with this Section by posting the 
2    required information on the website of the facility's

7    Section 20. The MC/DD Act is amended  by adding Section 
83-613 as follows:
 
9    (210 ILCS 46/3-613 new)
10    Sec. 3-613. Posting of Long Term Care Ombudsman Program 
11information.
12    (a)   Except as provided under subsection (b), all licensed 
13facilities shall post on the home page of the facility's 
14website the following:
15        (1) The statement "The Illinois Long Term Care 
16    Ombudsman Program is a free resident advocacy service 
17    available to the public.".
18        (2)   The Long Term Care Ombudsman Program's statewide 
19    toll-free telephone number.
20        (3) A link to the Long Term Care Ombudsman Program's 
21    website.

10    (a)   Except as provided under subsection (b), all licensed 
11facilities shall post on the home page of the facility's 
12website the following:
13        (1) The statement "The Illinois Long Term Care

17    toll-free telephone number.

3    Section 99. Effective date. This Act takes effect January 
41, 2023.".
