SYNOPSIS AS INTRODUCED:

Amends various Acts relating to the governance of public universities and community colleges in Illinois. Requires the governing board of each public university or a community college to notify a part-time or non-tenure track faculty member about the status of enrollment of the class the faculty member was hired to teach at least 30 days before the beginning of a term and again at 14 days before the beginning of the term. Requires the governing board of each public university and community college district to provide an adjunct professor or part-time or non-tenure track faculty member hired to teach a class on campus during an academic term with free campus parking or full reimbursement for the cost of campus parking for that academic term.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The University of Illinois Act is amended by renumbering and changing Section 120, as added by Public Act 102-260, and by adding Section 160 as follows:

Sec. 135 120. Adjunct professor or part-time or non-tenure track faculty member; status of class.

(a) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, the Board of Trustees must notify an adjunct professor about the status of enrollment of the class the adjunct professor was hired to teach.

(a-5) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, the Board of Trustees must notify a part-time or non-tenure track faculty member about the status of enrollment of the class the faculty member was hired to teach.

(b) This Section does not apply if the Governor has declared a disaster due to a public health emergency or a natural disaster pursuant to Section 7 of the Illinois Emergency Management Agency Act.

(c) Collective bargaining agreements that are in effect on January 1, 2022 (the effective date of Public Act 102-260) this amendatory Act of the 102nd General Assembly are exempt from the requirements of subsection (a) this Section. Collective bargaining agreements that are in effect on the effective date of this amendatory Act of the 102nd General Assembly are exempt from the requirements of subsection (a-5).

Sec. 160. Free parking for adjunct professors and part-time or non-tenure track faculty members. The Board of Trustees shall provide an adjunct professor or part-time or non-tenure track faculty member hired to teach a class on campus during an academic term with free campus parking or full reimbursement for the cost of campus parking for that academic term.

Section 10. The Southern Illinois University Management Act is amended by renumbering and changing Section 100, as added by Public Act 102-260, and by adding Section 135 as follows:

(a) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, the Board must notify an adjunct professor about the status of enrollment of the class the adjunct professor was hired to teach.

(a-5) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, the Board must notify a part-time or non-tenure track faculty member about the status of enrollment of the class the faculty member was hired to teach.

(b) This Section does not apply if the Governor has declared a disaster due to a public health emergency or a natural disaster pursuant to Section 7 of the Illinois Emergency Management Agency Act.

Section 15. The Chicago State University Law is amended by renumbering and changing Section 5-210, as added by Public Act 102-260, and by adding Section 5-245 as follows:

Section 50. The Public Community College Act is amended by renumbering and changing Section 3-29.14, as added by Public Act 102-260, and by adding Section 3-29.20 as follows:

Sec. 3-29.16 3-29.14. Adjunct professor or part-time or non-tenure track faculty member; status of class.

(a) At least 30 days before the beginning of a semester or term and again at 14 days before the beginning of the semester or term, a community college must notify an adjunct professor about the status of class enrollment of the class the adjunct professor was assigned to teach.

(a-5) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, a community college must notify a part-time or non-tenure track faculty member about the status of enrollment of the class the faculty member was hired to teach.

(b) This Section does not apply if the Governor has declared a disaster due to a public health emergency or a natural disaster pursuant to Section 7 of the Illinois Emergency Management Agency Act.

(c) Collective bargaining agreements that are in effect on January 1, 2022 (the effective date of Public Act 102-260) this amendatory Act of the 102nd General Assembly are exempt from the requirements of subsection (a) this Section.
