| 1 | AMENDMENT TO HOUSE BILL 5463

| 2 | AMENDMENT NO. ______. Amend House Bill 5463, AS AMENDED, | ||||||
| 3 | by replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 5. The Illinois Highway Code is amended by adding | ||||||
| 6 | Section 9-112.6 as follows: | ||||||
| 7 | (605 ILCS 5/9-112.6 new) | ||||||
| 8 | Sec. 9-112.6. Vegetation control permit. | ||||||
| 9 | (a) The Department may provide for vegetation control on | ||||||
| 10 | land or a right-of-way under its jurisdiction related to the | ||||||
| 11 | visibility of a permitted or registered outdoor advertising | ||||||
| 12 | sign or grant a permit for such work. | ||||||
| 13 | (b) The Department may issue rules to provide the | ||||||
| 14 | standards and procedures for vegetation control, including, | ||||||
| 15 | but not limited to, permit applications, permits, revocations, | ||||||
| 16 | and the requirements for the replacement of vegetation and | ||||||
| |||||||
| |||||||
| 1 | landscaping removal to establish clear visibility zones of | ||||||
| 2 | signs along highways in the State under its jurisdiction. | ||||||
| 3 | (c) The Department shall allow the cutting or trimming of | ||||||
| 4 | vegetation to clear a visibility zone 250 feet in front of a | ||||||
| 5 | single-sided sign and 250 feet in front of each side of a | ||||||
| 6 | double-sided sign. The visibility zone for signs shall also | ||||||
| 7 | include an additional 250-foot triangular section measured | ||||||
| 8 | diagonally from the edge of the right-of-way to the edge of | ||||||
| 9 | pavement. This distance shall be measured from the edge of the | ||||||
| 10 | sign face closest to the pavement in a direction parallel to | ||||||
| 11 | the pavement. All cutting or trimming of vegetation shall | ||||||
| 12 | maintain environmental compliance and in no event shall the | ||||||
| 13 | cutting or trimming of vegetation violate safety rules of the | ||||||
| 14 | Department. | ||||||
| 15 | (d) The Department shall process a completed vegetation | ||||||
| 16 | control application within 45 days of receiving such an | ||||||
| 17 | application.
| ||||||
| 18 | Section 99. Effective date. This Act takes effect 3 months | ||||||
| 19 | after becoming law.".
