| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Environmental Protection Act is amended by |
| 5 | | changing Section 39.4 as follows:
|
| 6 | | (415 ILCS 5/39.4) (from Ch. 111 1/2, par. 1039.4)
|
| 7 | | Sec. 39.4.
(a) Upon receipt of a joint application |
| 8 | | transmitted from
the
the Department of Agriculture for an |
| 9 | | agrichemical facility construction or
operation permit or a |
| 10 | | lawncare containment permit, the Agency may provide a
written |
| 11 | | endorsement of the permit to be issued by the Department for |
| 12 | | such
agrichemical facility or lawncare wash water containment |
| 13 | | area. The Agency's
endorsement may be provided at any time |
| 14 | | prior to final action by the Department
regarding the subject |
| 15 | | permit. |
| 16 | | (b) For all purposes of this Act, an agrichemical facility |
| 17 | | permit
or lawncare containment permit endorsed by the Agency |
| 18 | | pursuant to this Section
shall be deemed to be a permit issued |
| 19 | | by the Agency pursuant to subsection (b)
of Section 9 and |
| 20 | | subsection (b) of Section 12 of this Act. An agrichemical
|
| 21 | | facility or a lawncare wash water containment area remains |
| 22 | | subject to all
applicable permit requirements under this Act |
| 23 | | if the Department of
Agriculture's agrichemical facility |
