2 | AMENDMENT NO. ______. Amend Senate Bill 633 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Department of State Police Law of the
| ||||||
5 | Civil Administrative Code of Illinois is amended by adding | ||||||
6 | Section 2605-615 as follows: | ||||||
7 | (20 ILCS 2605/2605-615 new) | ||||||
8 | Sec. 2605-615. Sexual assault data. The Illinois State | ||||||
9 | Police shall post on its website for each school year the total | ||||||
10 | number of sexual assault incidents reported by school | ||||||
11 | districts statewide and in each school district under Sections | ||||||
12 | 10-20.75 and 34-18.67 of the School Code. The Illinois State | ||||||
13 | Police shall also report the data annually to the General | ||||||
14 | Assembly no later than September 1 of each year. | ||||||
15 | Section 10. The School Code is amended by adding Sections |

1 | 2-3.182, 10-20.75, and 34-18.67 as follows: | ||||||
2 | (105 ILCS 5/2-3.182 new) | ||||||
3 | Sec. 2-3.182. Sexual assault data. The State Board of | ||||||
4 | Education shall provide a link on its website to the website of | ||||||
5 | the Illinois State Police where the sexual assault data | ||||||
6 | reported under Sections 10-20.75 and 34-18.67 of this Code may | ||||||
7 | be accessed by the public. | ||||||
8 | (105 ILCS 5/10-20.75 new) | ||||||
9 | Sec. 10-20.75. Attacks on students; sexual assault. | ||||||
10 | (a) In this Section, "sexual assault" means any act of | ||||||
11 | nonconsensual sexual conduct or sexual penetration, as defined | ||||||
12 | under Section 11-0.1 of the Criminal Code of 2012, including, | ||||||
13 | but not limited to, acts prohibited under Sections 11-1.20 | ||||||
14 | through 11-1.60 of the Criminal Code of 2012. | ||||||
15 | (b) Upon knowledge of an incident of sexual assault by a | ||||||
16 | student against another student, a school district shall | ||||||
17 | report the incident to the State Board of Education and the | ||||||
18 | Illinois State Police. | ||||||

20 | Sec. 34-18.67. Attacks on students; sexual assault. | ||||||
21 | (a) In this Section, "sexual assault" means any act of | ||||||
