| 1 | | AN ACT concerning government.
|
| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Insurance Code is amended by |
| 5 | | changing Section 370c.2 as follows: |
| 6 | | (215 ILCS 5/370c.2) |
| 7 | | (Section scheduled to be repealed on December 31, 2021) |
| 8 | | Sec. 370c.2. Task force on disability income insurance; |
| 9 | | parity for behavioral health conditions. |
| 10 | | (a) As used in this Section, "behavioral health condition" |
| 11 | | means any mental, emotional, nervous, or substance use |
| 12 | | disorder or condition that falls under any of the diagnostic |
| 13 | | categories listed in the mental and behavioral disorders |
| 14 | | chapter of the current edition of the International |
| 15 | | Classification of Disease or that is listed in the most recent |
| 16 | | version of the Diagnostic and Statistical Manual of Mental |
| 17 | | Disorders. |
| 18 | | (b) The Department shall form a task force to review the |
| 19 | | plans and policies for individual and group short-term and |
| 20 | | long-term disability income insurance issued and offered to |
| 21 | | individuals and employers in this State in order to examine |
| 22 | | the use of such insurance for behavioral health conditions. |
| 23 | | The Task Force shall work cooperatively with the insurance |

| 1 | | industry, community organizations, businesses and business |
| 2 | | coalitions, and advocacy groups to reduce the stigma of |
| 3 | | behavioral health conditions. The task force shall be |
| 4 | | comprised of the following members: |
| 5 | | (1) 2 representatives of the disability income |
| 6 | | insurance industry appointed by the Governor. |
| 7 | | (2) 2 experts in the behavioral health conditions and |
| 8 | | treatment industry appointed by the Governor. |
| 9 | | (3) 2 consumers of disability income insurance who |
| 10 | | have experienced or are experiencing a behavioral health |
| 11 | | condition appointed by the Governor. |
| 12 | | (4) One member of the General Assembly appointed by |
| 13 | | the Speaker of the House of Representatives. |
| 14 | | (5) One member of the General Assembly appointed by |
| 15 | | the President of the Senate. |
| 16 | | (6) One member of the General Assembly appointed by |
| 17 | | the Minority Leader of the House of Representatives. |
| 18 | | (7) One member of the General Assembly appointed by |
| 19 | | the Minority Leader of the Senate. |
| 20 | | (c) The task force shall elect a chairperson from its |
| 21 | | membership and shall have the authority to determine its |
| 22 | | meeting schedule, hearing schedule, and agendas. |
| 23 | | (d) Appointments shall be made 90 days after the effective |
| 24 | | date of this amendatory Act of the 101st General Assembly. |
| 25 | | (e) Members shall serve without compensation and shall be |
| 26 | | adults and residents of Illinois. |

| 1 | | (f) The task force shall: |
| 2 | | (1) review existing plans and policies for individual |
| 3 | | and group short-term and long-term disability income |
| 4 | | insurance issued, delivered, and offered in the State; |
| 5 | | (2) compare coverage provided by short-term and |
| 6 | | long-term disability income insurance policies for |
| 7 | | behavioral health conditions with coverage provided by |
| 8 | | such policies for physical conditions and the reasons for |
| 9 | | differences in coverage; |
| 10 | | (3) gather information on the cost of requiring |
| 11 | | individual and group short-term and long-term disability |
| 12 | | income insurance to cover behavioral health conditions at |
| 13 | | parity with physical conditions; and |
| 14 | | (4) provide recommendations on the economic |
| 15 | | feasibility and cost effectiveness of requiring individual |
| 16 | | and group short-term and long-term disability income |
| 17 | | insurance to cover behavioral health conditions. |
| 18 | | (g) Any of the findings, recommendations, and other |
| 19 | | information determined by the task force to be relevant shall |
| 20 | | be made available on the Department's website. |
| 21 | | (h) The task force shall submit findings and |
| 22 | | recommendations to the Governor and the General Assembly by |
| 23 | | December 31, 2022 2020. |
| 24 | | (i) The task force is dissolved and this Section is |
| 25 | | repealed on January 1, 2023 December 31, 2021.
