| 1 | | licensee's renewal of his or her license. The Department shall |
| 2 | | not refuse to renew a license if a license does not complete |
| 3 | | the training requirements in this subsection (a). As used in |
| 4 | | this Section, "sexual harassment" means any unwelcome sexual |
| 5 | | advances or requests for sexual favors or any conduct of a |
| 6 | | sexual nature when: (i) submission to such conduct is made |
| 7 | | either explicitly or implicitly a term or condition of an |
| 8 | | individual's employment; (ii) submission to or rejection of |
| 9 | | such conduct by an individual is used as the basis for |
| 10 | | employment decisions affecting such individual; or (iii) such |
| 11 | | conduct has the purpose or effect of substantially interfering |
| 12 | | with an individual's work performance or creating an |
| 13 | | intimidating, hostile, or offensive working environment. For |
| 14 | | the purpose of this definition, "working environment" is not |
| 15 | | limited to a physical location that an employee is assigned to |
| 16 | | perform his or her duties and does not require an employment |
| 17 | | relationship. |
| 18 | | (b) For license renewals occurring on or after January 1, |
| 19 | | 2020 for a profession that has continuing education |
| 20 | | requirements, the required continuing education hours shall |
| 21 | | include at least one hour of sexual harassment prevention |
| 22 | | training. |
| 23 | | (b) (c) The Department may adopt rules for the |
| 24 | | implementation of this Section.
