AMENDMENT TO SENATE BILL 1104

AMENDMENT NO. ______. Amend Senate Bill 1104 as follows:

on page 5, immediately below line 4, by inserting the following:

"(10) Pursuant to Public Act 102-662, the General Assembly has determined that to provide the highest quality of life for the residents of Illinois and to provide for a clean and healthy environment, it is the policy of this State to rapidly transition to 100% clean energy by 2050. Reducing carbon dioxide and copollutant emissions in a manner that does not threaten electric reliability and resource adequacy is essential to the health and safety of all Illinois citizens. Coal-fueled generation located in Illinois, and particularly in the downstate region, has recently been retired or will be retired by no later than the end of 2027. Natural gas-fueled generation located in Illinois is currently required to curtail operations if emission limits are exceeded pursuant to Public Act 102-662.

(11) Reliable electric service at all times is essential to the functioning of a modern economy and of society in general. The health, welfare, and prosperity of Illinois citizens, including the attractiveness of Illinois to business and industry, requires the availability of sufficient electric generating capacity, including energy storage capacity, to meet the demands of consumers and businesses in this State at all times."; and

on page 5, by replacing lines 7 through 19 with the following:

"(a) The Illinois Regional Generation Reliability Task Force is created. The Task Force shall examine the State's current progress toward its renewable energy resource development goals and monitor the reliability of the Illinois power grid and the status of CO₂e and copollutant emissions reductions, the current status and progress toward developing and implementing green hydrogen technologies, and the current and projected status of electric resource adequacy and reliability throughout the State. The Task Force should consider the impacts of climate change on Illinois residents and the present and future needs of Illinois consumers while simultaneously investigating, and recommending solutions for, any issues related to the performance and reliability of power generation and transmission and being mindful of the ultimate cost to consumers.

(b) The duties and responsibilities of the Task Force include the following:

(1) Identifying and assessing policies, rules, laws, and risks that have the potential to significantly affect the reliability of the regional electric transmission grids and increase greenhouse gas emissions."; and

by replacing line 23 on page 6 through line 17 on page 9 with the following:

"Section 15. Membership; meetings.

(a) The members of the Illinois Regional Generation Reliability Task Force shall be composed of the following:

(1) one Senator, appointed by the President of the Senate, who shall serve as a co-chair of the Task Force;

(2) one member of the House of Representatives, appointed by the Speaker of the House of Representatives, who shall serve as a co-chair of the Task Force;

(3) one Senator, appointed by the Minority Leader of the Senate;

(4) one member of the House of Representatives, appointed by the Minority Leader of the House of Representatives;

(5) one member who is a State employee with responsibility for establishing State energy policies, appointed by the Governor;

(6) one member of a State or local labor organization, appointed by the President of the Senate;

(7) one representative from the PJM Regional Transmission Organization, designated by PJM;

(8) one representative from the PJM Independent Market Monitor organization, designated by the PJM Independent Market Monitor organization;

(9) one representative from MISO Regional Transmission Organization, designated by MISO;

(10) one representative from the MISO Independent Market Monitor organization, designated by the MISO Independent Market Monitor organization;

(11) 6 representatives from 6 different power generation companies that operate in the PJM or MISO regional transmission organization, 3 appointed by the President of the Senate and 3 appointed by the Speaker of the House of Representatives;

(12) one representative from a minority-owned geothermal company, appointed by the President of the Senate;

(13) 3 representatives from environmental groups, appointed by the Governor;

(14) the Director of the Illinois Power Agency or the Director's designee;

(15) the Director of the Environmental Protection Agency or the Director's designee;

(16) the Chair of the Illinois Commerce Commission, or the Chair's designee;

(17) 2 representatives from a renewable energy generation company or a trade association representing wind or solar generators, appointed by the President of the Senate;

(18) one representative of a transmission company in the PJM or MISO RTO, appointed by the President of the Senate;

(19) one representative of an electric distribution utility serving more than 500,000 but less than 3,000,000 customers in this State, its affiliated transmission company, or its designated representative, as applicable, that operates in MISO Zone 4, designated by MISO; and

(20) one representative from an electric utility that operates distribution in the PJM regional transmission organization in Illinois with over 60,000 miles of primary distribution conductor miles and more than 400 megawatts of interconnected distribution facilities, designated by PJM, or a representative from a company that operates transmission in the PJM regional transmission organization in Illinois with an average hourly load in Illinois that exceeds 10,000 megawatts, designated by PJM.

(b) Appointments for the Task Force shall be made by July 1, 2022. The Task Force shall hold 7 meetings annually, either remotely or in person, and the first meeting shall be held within 30 days after appointments are made.

(c) Members of the Task Force shall serve without compensation.

(d) The Illinois Commerce Commission shall provide administrative support to the Task Force in conjunction with the Independent Market Monitors for the MISO and PJM Regional Transmission Organizations."; and

on page 10, by replacing lines 3 through 5, with "a second report on February 1, 2024, to the General Assembly upon the completion of its meeting schedule."; and

on page 10, immediately below line 5, by inserting the following:

"Section 25. Repealer. This Act is repealed 2 years after its effective date.".
