2 | | AMENDMENT NO. ______. Amend Senate Bill 1471 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 1. Short title. This Act may be cited as the |
5 | | Outbreak Preparedness Act. |
6 | | Section 5. Definitions. In this Act: |
7 | | "Department" means the Department of Public Health. |
8 | | "Facility" means a private or public home, institution, |
9 | | building, residence, or any other place, whether operated for |
10 | | profit or not, or a county home for the infirm and chronically |
11 | | ill that provides, through its ownership or management, |
12 | | personal care, sheltered care, or nursing for 3 or more |
13 | | persons, not related to the applicant or owner by blood or |
14 | | marriage. "Facility" includes skilled nursing facilities and |
15 | | intermediate care facilities as those terms are defined in |
16 | | Title XVIII and Title XIX of the federal Social Security Act |

1 | | and homes, institutions, or other places operated by or under |
2 | | the authority of the Illinois Department of Veterans' Affairs. |
3 | | "Facility" does not include the following: |
4 | | (1) A home, institution, or other place operated by |
5 | | the federal government or an agency thereof. |
6 | | (2) A hospital, sanitarium, or other institution whose |
7 | | principal activity or business is the diagnosis, care, and |
8 | | treatment of human illness through the maintenance and |
9 | | operation as an organized facility therefor, and that is |
10 | | required to be licensed under the Hospital Licensing Act. |
11 | | (3) Any facility for child care as defined in Section |
12 | | 2.05 of the Child Care Act of 1969. |
13 | | (4) Any Community Living Facility as defined in |
14 | | Section 3 of the Community Living Facilities Licensing |
15 | | Act. |
16 | | (5) Any nursing home or sanatorium operated solely by |
17 | | and for persons who rely exclusively upon treatment by |
18 | | spiritual means through prayer, in accordance with the |
19 | | creed or tenets of any well-recognized church or religious |
20 | | denomination. However, the nursing home or sanatorium |
21 | | shall comply with all local laws and rules relating to |
22 | | sanitation and safety. |
23 | | (6) A medical foster home, as defined in 38 CFR 17.73, |
24 | | that is under the oversight of the United States |
25 | | Department of Veterans Affairs.

1 | | Section 10. Infectious disease outbreak procedures. A |
2 | | facility shall create procedures for limiting the spread of an |
3 | | infectious disease outbreak, conduct training for all facility |
4 | | personnel, including contractors, and conduct yearly outbreak |
5 | | safety drills. |
6 | | Section 15. Emergency rulemaking. To provide for the |
7 | | expeditious and timely implementation of this Act, emergency |
8 | | rules to implement any provision of this Act may be adopted by |
9 | | the Department subject to the provisions of Section 5-45 of |
10 | | the Illinois Administrative Procedure Act. |
11 | | Section 80. The Illinois Administrative Procedure Act is |
12 | | amended by adding Section 5-45.8 as follows: |
13 | | (5 ILCS 100/5-45.8 new) |
14 | | Sec. 5-45.8. Emergency rulemaking; Outbreak Preparedness |
15 | | Act. To provide for the expeditious and timely implementation |
16 | | of the Outbreak Preparedness Act, emergency rules implementing |
17 | | the Outbreak Preparedness Act may be adopted in accordance |
18 | | with Section 5-45 by the Department of Public Health. The |
19 | | adoption of emergency rules authorized by Section 5-45 and |
20 | | this Section is deemed to be necessary for the public |
21 | | interest, safety, and welfare. |
22 | | This Section is repealed on January 1, 2027.
