SYNOPSIS AS INTRODUCED:

    Amends the University of Illinois Hospital Act, the Ambulatory Surgical Treatment Center Act, the Hospital Licensing Act, and the Pharmacy Practice Act. Requires hospitals, facilities, and pharmacies to offer a patient any unused portion of a facility-provided medication upon discharge when it is administered to a patient at the hospital, facility, or pharmacy and is required for continuing treatment. Defines "facility-provided medication".

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Hospital Act is
5amended by adding Section 8d as follows:
 
6    (110 ILCS 330/8d new)
7    Sec. 8d. Facility-provided medication upon discharge.
8    (a) The General Assembly finds that this Section is
9necessary for the immediate preservation of the public peace,
10health, and safety.
11    (b) In this Section, "facility-provided medication" has
12the same meaning as provided under Section 15.10 of the
13Pharmacy Practice Act.
14    (c) When a facility-provided medication is administered to
15a patient at the University of Illinois Hospital, any unused
16portion of the facility-provided medication must be offered to
17the patient upon discharge when it is required for continuing
18treatment.
19    (d) A facility-provided medication shall be labeled
20consistent with labeling requirements under Section 33 of the
21Medical Practice Act of 1987.
 
22    Section 10. The Ambulatory Surgical Treatment Center Act

2    (210 ILCS 5/7d new)

16consistent with labeling requirements under Section 33 of the
17Medical Practice Act of 1987.
 
18    Section 15. The Hospital Licensing Act is amended by
19adding Section 6.28 as follows:

21    Sec. 6.28. Facility-provided medication upon discharge.
22    (a) The General Assembly finds that this Section is

13    Section 20. The Pharmacy Practice Act is amended by adding
14Section 15.10 as follows:
 
15    (225 ILCS 85/15.10 new)
16    Sec. 15.10. Facility-provided medication upon discharge.
17    (a) The General Assembly finds that this Section is
18necessary for the immediate preservation of the public peace,
19health, and safety.
20    (b) In this Section, "facility-provided medication" means
21any topical antibiotic, anti-inflammatory, dilation, or
22glaucoma drop or ointment.
23    (c) When a facility-provided medication is administered to
24a patient at a pharmacy, any unused portion of the

1facility-provided medication must be offered to the patient
2upon discharge when it is required for continuing treatment.
3    (d) A facility-provided medication shall be labeled
4consistent with labeling requirements under Section 33 of the
5Medical Practice Act of 1987.
