| 4 | | "Section 5. The Animal Control Act is amended by changing |
| 5 | | Sections 2.11c, 3.5, and 9 as follows:

| 8 | | that has not been sterilized spayed or neutered.

| 15 | | dogs or cats owned by low income county residents who are |

| 5 | | 3,000,000 or more inhabitants.

| 8 | | Sec. 9. Any dog found running at large contrary to |
| 9 | | provisions of this Act
may
be apprehended and impounded. For |
| 10 | | this purpose, the Administrator shall
utilize any existing or |
| 11 | | available animal control facility or licensed animal shelter. |
| 12 | | The dog's owner shall pay a $25 public safety fine to be |
| 13 | | deposited into the county animal control fund or the county |
| 14 | | pet population control fund. Funds transferred to or retained |
| 15 | | by a municipality before the effective date of this amendatory |
| 16 | | Act of the 100th General Assembly under this paragraph shall |
| 17 | | continue to be transferred to and be retained by that |
| 18 | | municipality. A dog found running at large contrary to the |
| 19 | | provisions of this Act a second or subsequent time must be |
| 20 | | sterilized spayed or neutered within 30 days after being |
| 21 | | reclaimed unless already sterilized spayed or neutered; |
| 22 | | failure to comply shall result in impoundment.

| 23 | | A dog that is actively engaged in a legal hunting |
| 24 | | activity, including training, is not considered to be running |
| 25 | | at large if the dog is on land that is open to hunting or on |
