| 4 | | "Section 5. The Interagency Wetland Policy Act of 1989 is |
| 5 | | amended by adding Section 1-7 as follows:

| 7 | | Sec. 1-7. Alexander-Cairo Port District. Alexander-Cairo |
| 8 | | Port District. Notwithstanding any other provision of this |
| 9 | | Act, this Act does not apply to construction activities at |
| 10 | | facilities or property covered by the Alexander-Cairo Port |
| 11 | | District Act, provided that such facilities or property are |
| 12 | | located within 6 miles of the confluence of the Ohio River and |
| 13 | | the Mississippi River, and further provided that such actions |
| 14 | | comply with the applicable mitigation requirements contained |
| 15 | | in 40. C.F.R. Part 230.".
