| 1 | AN ACT concerning State government.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 1. This Act may be referred to as the Illinois | |||||||||||||||||||
| 5 | State Police Line of Duty Preference Act of 2021. | |||||||||||||||||||
| 6 | Section 5. The State Police Act is amended by changing | |||||||||||||||||||
| 7 | Section 9 as follows:
| |||||||||||||||||||

| 9 | Sec. 9. Appointment; qualifications.
| |||||||||||||||||||
| 10 | (a) Except as otherwise provided in this Section, the | |||||||||||||||||||
| 11 | appointment of
Department of State Police officers shall be | |||||||||||||||||||
| 12 | made from those applicants who
have been certified by the | |||||||||||||||||||
| 13 | Board as being qualified for appointment. All
persons so | |||||||||||||||||||
| 14 | appointed shall, at the time of their appointment, be not less | |||||||||||||||||||
| 15 | than
21 years of age, or 20 years of age and have successfully | |||||||||||||||||||
| 16 | completed an associate's degree or 60 credit hours at an | |||||||||||||||||||
| 17 | accredited college or university. Any person
appointed | |||||||||||||||||||
| 18 | subsequent to successful completion of an associate's degree | |||||||||||||||||||
| 19 | or 60 credit hours at an accredited college or university | |||||||||||||||||||
| 20 | shall not have power of arrest, nor shall he or she be | |||||||||||||||||||
| 21 | permitted
to carry firearms, until he or she reaches 21 years | |||||||||||||||||||
| 22 | of age. In addition,
all persons so certified for appointment | |||||||||||||||||||
| |||||||
| |||||||
| 1 | shall be of sound mind and body, be of
good moral character, be | ||||||
| 2 | citizens of the United States, have no criminal
records, | ||||||
| 3 | possess such prerequisites of training, education, and | ||||||
| 4 | experience as
the Board may from time to time prescribe so long | ||||||
| 5 | as persons who have an associate's degree or 60 credit hours at | ||||||
| 6 | an accredited college or university are not disqualified, and | ||||||
| 7 | shall be required to pass
successfully such mental and | ||||||
| 8 | physical tests and examinations as may be
prescribed by the | ||||||
| 9 | Board. All persons who meet one of the following requirements | ||||||
| 10 | are deemed to have met the collegiate educational | ||||||
| 11 | requirements: | ||||||
| 12 | (i) have been honorably discharged and who have been | ||||||
| 13 | awarded a Southwest Asia Service Medal, Kosovo Campaign | ||||||
| 14 | Medal, Korean Defense Service Medal, Afghanistan Campaign | ||||||
| 15 | Medal, Iraq Campaign Medal, or Global War on Terrorism | ||||||
| 16 | Expeditionary Medal by the United States Armed Forces; | ||||||
| 17 | (ii) are active members of the Illinois National Guard | ||||||
| 18 | or a reserve component of the United States Armed Forces | ||||||
| 19 | and who have been awarded a Southwest Asia Service Medal, | ||||||
| 20 | Kosovo Campaign Medal, Korean Defense Service Medal, | ||||||
| 21 | Afghanistan Campaign Medal, Iraq Campaign Medal, or Global | ||||||
| 22 | War on Terrorism Expeditionary Medal as a result of | ||||||
| 23 | honorable service during deployment on active duty; | ||||||
| 24 | (iii) have been honorably discharged who served in a | ||||||
| 25 | combat mission by proof of hostile fire pay or imminent | ||||||
| 26 | danger pay during deployment on active duty; or | ||||||
| |||||||
| |||||||
| 1 | (iv) have at least 3 years of full active and | ||||||
| 2 | continuous military duty and received an honorable | ||||||
| 3 | discharge before hiring. | ||||||
| 4 | Preference shall be given in such appointments to
persons | ||||||
| 5 | who have honorably served in the military or naval services of | ||||||
| 6 | the
United States or to the son, daughter, stepson, | ||||||
| 7 | stepdaughter, grandson, granddaughter, brother, or sister of a | ||||||
| 8 | law enforcement officer who was killed in the line of duty as | ||||||
| 9 | defined in Section 2 of the Line of Duty Compensation Act. All | ||||||
| 10 | appointees shall serve a probationary period of 12 months
from | ||||||
| 11 | the date of appointment and during that period may be | ||||||
| 12 | discharged at the
will of the Director. However, the Director | ||||||
| 13 | may in his or her sole discretion
extend the probationary | ||||||
| 14 | period of an officer up to an additional 6 months when
to do so | ||||||
| 15 | is deemed in the best interest of the Department. Nothing in | ||||||
| 16 | this subsection (a) limits the Board's ability to prescribe | ||||||
| 17 | education prerequisites or requirements to certify Department | ||||||
| 18 | of State Police officers for promotion as provided in Section | ||||||
| 19 | 10 of this Act.
| ||||||
| 20 | (b) Notwithstanding the other provisions of this Act, | ||||||
| 21 | after July 1,
1977 and before July 1, 1980, the Director of | ||||||
| 22 | State Police may appoint and
promote not more than 20 persons | ||||||
| 23 | having special qualifications as special
agents as he or she | ||||||
| 24 | deems necessary to carry out the Department's objectives. Any
| ||||||
| 25 | such appointment or promotion shall be ratified by the Board.
| ||||||
| 26 | (c) During the 90 days following the effective date of | ||||||
| |||||||
| |||||||
| 1 | this amendatory Act
of 1995, the Director of State Police may | ||||||
| 2 | appoint up to 25 persons as State
Police officers. These | ||||||
| 3 | appointments shall be made in accordance with the
requirements | ||||||
| 4 | of this subsection (c) and any additional criteria that may be
| ||||||
| 5 | established by the Director, but are not subject to any other | ||||||
| 6 | requirements of
this Act. The Director may specify the initial | ||||||
| 7 | rank for each person appointed
under this subsection.
| ||||||
| 8 | All appointments under this subsection (c) shall be made | ||||||
| 9 | from personnel
certified by the Board. A person certified by | ||||||
| 10 | the Board and appointed by the
Director under this subsection | ||||||
| 11 | must have been employed by the Illinois Commerce
Commission on | ||||||
| 12 | November 30, 1994 in a job title
subject to the Personnel Code | ||||||
| 13 | and in a position for which the person was
eligible to earn | ||||||
| 14 | "eligible creditable service" as a "noncovered employee", as
| ||||||
| 15 | those terms are defined in Article 14 of the Illinois Pension | ||||||
| 16 | Code.
| ||||||
| 17 | Persons appointed under this subsection (c) shall | ||||||
| 18 | thereafter be subject to
the same requirements and procedures | ||||||
| 19 | as other State police officers. A person
appointed under this | ||||||
| 20 | subsection must serve a probationary period of 12 months
from | ||||||
| 21 | the date of appointment, during which he or she may be | ||||||
| 22 | discharged at the
will of the Director.
| ||||||
| 23 | This subsection (c) does not affect or limit the | ||||||
| 24 | Director's authority to
appoint other State Police officers | ||||||
| 25 | under subsection (a) of this Section.

| 1 | Section 99. Effective date. This Act takes effect upon | ||||||
| 2 | becoming law.
