| 1 | | AN ACT concerning education.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by changing Sections |
| 5 | | 10-16a and 10-22.39 as follows: |
| 6 | | (105 ILCS 5/10-16a) |
| 7 | | Sec. 10-16a. School board member's leadership training. |
| 8 | | (a) This Section applies to all school board members |
| 9 | | serving pursuant to Section 10-10 of this Code who have been |
| 10 | | elected after the effective date of this amendatory Act of the |
| 11 | | 97th General Assembly or appointed to fill a vacancy of at |
| 12 | | least one year's duration after the effective date of this |
| 13 | | amendatory Act of the 97th General Assembly. |
| 14 | | (b) Every voting member of a school board of a school |
| 15 | | district elected or appointed for a term beginning after the |
| 16 | | effective date of this amendatory Act of the 97th General |
| 17 | | Assembly, within a year after the effective date of this |
| 18 | | amendatory Act of the 97th General Assembly or the first year |
| 19 | | of his or her first term, shall complete a minimum of 4 hours |
| 20 | | of professional development leadership training covering |
| 21 | | topics in education and labor law, financial oversight and |
| 22 | | accountability, and fiduciary responsibilities of a school |
| 23 | | board member, and, beginning with the 2022-2023 school year, |

| 1 | | trauma-informed practices for students and staff. The school |
| 2 | | district shall maintain on its Internet website, if any, the |
| 3 | | names of all voting members of the school board who have |
| 4 | | successfully completed the training. |
| 5 | | (b-5) The training for trauma-informed practices for |
| 6 | | students and staff required under this Section must include, |
| 7 | | but is not limited to, all of the following information that is |
| 8 | | relevant to and within the scope of the duties of a school |
| 9 | | board member: |
| 10 | | (1) The recognition of and care for trauma in students |
| 11 | | and educators. |
| 12 | | (2) The relationship between educator wellness and |
| 13 | | student learning. |
| 14 | | (3) The effect of trauma on student behavior and |
| 15 | | learning. |
| 16 | | (4) The prevalence of trauma among students, including |
| 17 | | the prevalence of trauma among student populations at |
| 18 | | higher risk of experiencing trauma. |
| 19 | | (5) The effects of implicit or explicit bias on |
| 20 | | recognizing trauma among various racial or ethnic groups |
| 21 | | of students. |
| 22 | | (6) Effective district and school policies and |
| 23 | | practices that are shown to: |
| 24 | | (A) prevent and mitigate the negative effect of |
| 25 | | trauma on student behavior and learning; and |
| 26 | | (B) support the emotional wellness of educators. |

| 1 | | (c) The training on financial oversight, accountability, |
| 2 | | and fiduciary responsibilities, and, beginning with the |
| 3 | | 2022-2023 school year, trauma-informed practices for students |
| 4 | | and staff may be provided by an association established under |
| 5 | | this Code for the purpose of training school board members or |
| 6 | | by other qualified providers approved by the State Board of |
| 7 | | Education, in consultation with an association so established.

| 8 | | (d) The State Board of Education may adopt any rules |
| 9 | | necessary to implement and administer this Section. |

|
| 12 | | Sec. 10-22.39. In-service training programs. |
| 13 | | (a) To conduct in-service training programs for teachers. |
| 14 | | (b) In addition to
other topics at in-service training
|
| 15 | | programs, at least once every 2 years, licensed school |
| 16 | | personnel and administrators who work with pupils in |
| 17 | | kindergarten through grade 12 shall be
trained to identify the |
| 18 | | warning signs of mental illness, trauma, and suicidal behavior |
| 19 | | in youth and shall be taught appropriate intervention and |
| 20 | | referral techniques. A school district may utilize the |
| 21 | | Illinois Mental Health First Aid training program, established |
| 22 | | under the Illinois Mental Health First Aid Training Act and |
| 23 | | administered by certified instructors trained by a national |
| 24 | | association recognized as an authority in behavioral health, |
| 25 | | to provide the training and meet the requirements under this |
|

| 1 | | subsection. If licensed school personnel or an administrator |
| 2 | | obtains mental health first aid training outside of an |
| 3 | | in-service training program, he or she may present a |
| 4 | | certificate of successful completion of the training to the |
| 5 | | school district to satisfy the requirements of this |
| 6 | | subsection. |
| 7 | | Training regarding the adoption and administration of a |
| 8 | | trauma-informed school standard satisfies the requirements of |
| 9 | | this subsection (b). |
| 10 | | A course of instruction as described in this subsection |
| 11 | | (b) may provide information that is relevant to and within the |
| 12 | | scope of the duties of licensed school personnel and school |
| 13 | | administrators. A course of instruction may include, but is |
| 14 | | not limited to, all of the following:
|
| 15 | | (1) The recognition of and care for trauma in students |
| 16 | | and educators. |
| 17 | | (2) The relationship between educator wellness and |
| 18 | | student learning. |
| 19 | | (3) The effect of trauma on student behavior and |
| 20 | | learning. |

| 24 | | (5) The effects of implicit or explicit bias on |
| 25 | | recognizing trauma among various racial or ethnic groups |

| 1 | | (6) Effective district and school policies and |
| 2 | | practices that are shown to: |
| 3 | | (A) prevent and mitigate the negative effect of |
| 4 | | trauma on student behavior and learning; and |
| 5 | | (B) support the emotional wellness of educators. |
| 6 | | (c) School guidance counselors, nurses, teachers and other |
| 7 | | school personnel
who work with pupils may be trained to have a |
| 8 | | basic knowledge of matters
relating to acquired |
| 9 | | immunodeficiency syndrome (AIDS), including the nature
of the |
| 10 | | disease, its causes and effects, the means of detecting it and
|
| 11 | | preventing its transmission, and the availability of |
| 12 | | appropriate sources of
counseling and referral, and any other |
| 13 | | information that may be appropriate
considering the age and |
| 14 | | grade level of such pupils. The School Board shall
supervise |
| 15 | | such training. The State Board of Education and the Department
|
| 16 | | of Public Health shall jointly develop standards for such |
| 17 | | training.
|
| 18 | | (d) In this subsection (d): |
| 19 | | "Domestic violence" means abuse by a family or household |
| 20 | | member, as "abuse" and "family or household members" are |
| 21 | | defined in Section 103 of the Illinois Domestic Violence Act |
| 22 | | of 1986. |
| 23 | | "Sexual violence" means sexual assault, abuse, or stalking |
| 24 | | of an adult or minor child proscribed in the Criminal Code of |
| 25 | | 1961 or the Criminal Code of 2012 in Sections 11-1.20, |
| 26 | | 11-1.30, 11-1.40, 11-1.50, 11-1.60, 12-7.3, 12-7.4, 12-7.5, |
|

| 1 | | 12-12, 12-13, 12-14, 12-14.1, 12-15, and 12-16, including |
| 2 | | sexual violence committed by perpetrators who are strangers to |
| 3 | | the victim and sexual violence committed by perpetrators who |
| 4 | | are known or related by blood or marriage to the victim. |
| 5 | | At least once every 2 years, an in-service training |
| 6 | | program for school personnel who work with pupils, including, |
| 7 | | but not limited to, school and school district administrators, |
| 8 | | teachers, school guidance counselors, school social workers, |
| 9 | | school counselors, school psychologists, and school nurses, |
| 10 | | must be conducted by persons with expertise in domestic and |
| 11 | | sexual violence and the needs of expectant and parenting youth |
| 12 | | and shall include training concerning (i) communicating with |
| 13 | | and listening to youth victims of domestic or sexual violence |
| 14 | | and expectant and parenting youth, (ii) connecting youth |
| 15 | | victims of domestic or sexual violence and expectant and |
| 16 | | parenting youth to appropriate in-school services and other |
| 17 | | agencies, programs, and services as needed, and (iii) |
| 18 | | implementing the school district's policies, procedures, and |
| 19 | | protocols with regard to such youth, including |
| 20 | | confidentiality. At a minimum, school personnel must be |
| 21 | | trained to understand, provide information and referrals, and |
| 22 | | address issues pertaining to youth who are parents, expectant |
| 23 | | parents, or victims of domestic or sexual violence.

| 24 | | (e) At least every 2 years, an in-service training program |
| 25 | | for school personnel who work with pupils must be conducted by |
| 26 | | persons with expertise in anaphylactic reactions and |
|

| 1 | | management.
|
| 2 | | (f) At least once every 2 years, a school board shall |
| 3 | | conduct in-service training on educator ethics, |
| 4 | | teacher-student conduct, and school employee-student conduct |
| 5 | | for all personnel. |

| 7 | | Section 99. Effective date. This Act takes effect upon |
| 8 | | becoming law.
