1 | AMENDMENT TO SENATE BILL 2339

2 | AMENDMENT NO. ______. Amend Senate Bill 2339 on page 1, by | ||||||
3 | replacing line 16, with the following: "defendant , or | ||||||
4 | defendant's attorney , advocate, or victim's attorney (as | ||||||
5 | defined in Section 3 of the Illinois Rights of Crime Victims | ||||||
6 | and Witnesses Act) in any criminal proceeding"; and | ||||||
7 | on page 2, immediately below line 2, by inserting: | ||||||
8 | " A court may prohibit such disclosure only after giving | ||||||
9 | notice and a hearing to all affected parties. In determining | ||||||
10 | whether to prohibit disclosure of the minor's identity the | ||||||
11 | court shall consider: | ||||||
12 | (1) the best interest of the child; and | ||||||
13 | (2) whether such nondisclosure would further a | ||||||
14 | compelling State interest. "; and

15 | on page 2, by replacing line 15 through line 24 with the | ||||||
16 | following: |

1 | " The copy of the criminal history record information to be | ||||||
2 | provided under this Section shall exclude the identity of the | ||||||
3 | child victim. The superintendent shall be restricted from | ||||||
4 | specifically
revealing the identity name of the victim without | ||||||
5 | written consent of the victim or
victim's parent or guardian . | ||||||
6 | Nothing in this Article precludes or may be used to preclude a | ||||||
7 | mandated reporter from reporting child abuse or child neglect | ||||||
8 | as required under the Abused and Neglected Child Reporting | ||||||
9 | Act. | ||||||
10 | A court may prohibit such disclosure only after giving | ||||||
