Amends the Criminal Code of 2012. Creates the offense of deceptive sale of pipeline components. Provides that a person commits the offense, when he or she sells, purchases, or trades a knowingly falsely labeled pipeline component that does not meet or exceed the industry safety standards adopted by the Illinois Commerce Commission, under the Illinois Gas Pipeline Safety Act, for the pipeline component. Provides that a violation is a Class A misdemeanor. Provides that if the violation results in death or great bodily harm to another person, deceptive sale of pipeline components is a Class 4 felony. Defines "component".

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 5. The Criminal Code of 2012 is amended by adding |
5 | | Section 17-63 as follows: |
6 | | (720 ILCS 5/17-63 new) |
7 | | Sec. 17-63. Deceptive sale of pipeline components. |
8 | | (a) In this Section, "component" means any part of a |
9 | | pipeline that may be subjected to pump pressure including, but |
10 | | not limited to, pipe, valves, elbows, tees, flanges, and |
11 | | closures. |
12 | | (b) A person commits deceptive sale of pipeline |
13 | | components, when he or she sells, purchases, or trades a |
14 | | knowingly falsely labeled pipeline component that does not |
15 | | meet or exceed the industry safety standards adopted by the |
16 | | Illinois Commerce Commission, under Section 3 of the Illinois |
17 | | Gas Pipeline Safety Act, for the pipeline component. |
18 | | (c) Deceptive sale of pipeline components is a Class A |
19 | | misdemeanor. If the violation results in death or great bodily |
20 | | harm to another person, deceptive sale of pipeline components |
21 | | is a Class 4 felony.
