Amends the Architectural, Engineering, and Land Surveying Qualifications Based Selection Act. Provides that the Department of Transportation shall not, for the purpose of establishing overhead rates in any contract entered into between the Department and an engineering firm, consider any loans forgiven under the federal Paycheck Protection Program as a credit to the government in a way that would result in a reduced payment amount owed to the engineering firm under the contract. Provides for the adoption of rules.

| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Architectural, Engineering, and Land |
| 5 | | Surveying
Qualifications Based Selection Act is amended by |
| 6 | | adding Section 43 as follows:
|
| 7 | | (30 ILCS 535/43 new) |
| 8 | | Sec. 43. Department of Transportation overhead rates. |
| 9 | | Notwithstanding any provision of law to the contrary, the |
| 10 | | Department of Transportation shall not, for the purpose of |
| 11 | | establishing overhead rates in any contract entered into |
| 12 | | between the Department and an engineering firm under this Act, |
| 13 | | consider any loans forgiven under the federal Paycheck |
| 14 | | Protection Program as a credit to the government in a way that |
| 15 | | would result in a reduced payment amount owed to the |
| 16 | | engineering firm under the contract. The Department of |
| 17 | | Transportation may adopt any rules necessary to implement this |
| 18 | | Section.
