    Amends the Lobbyist Registration Act. Requires that expenditures incurred for any registered lobbyist hosting fundraisers for a candidate for elected office or a Political Action Committee be reported, including all donations made, the name of the person who made the donation, and the amount of the donation.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Lobbyist Registration Act is amended by
5changing Section 6 as follows:
 
6    (25 ILCS 170/6)  (from Ch. 63, par. 176)
7    Sec. 6. Reports.
8    (a) Lobbyist reports. Except as otherwise provided in this
9Section, every lobbyist registered under this Act who is
10solely employed by a lobbying entity shall file an
11affirmation, verified under oath pursuant to Section 1-109 of
12the Code of Civil Procedure, with the Secretary of State
13attesting to the accuracy of any reports filed pursuant to
14subsection (b) as those reports pertain to work performed by
15the lobbyist. Any lobbyist registered under this Act who is
16not solely employed by a lobbying entity shall personally file
17reports required of lobbying entities pursuant to subsection
18(b). A lobbyist may, if authorized so to do by a lobbying
19entity by whom he or she is employed or retained, file lobbying
20entity reports pursuant to subsection (b) provided that the
21lobbying entity may delegate the filing of the lobbying entity
22report to only one lobbyist in any reporting period.
23    (b) Lobbying entity reports. Every lobbying entity

1registered under this Act shall report expenditures related to
2lobbying. The report shall itemize each individual expenditure
3or transaction and shall include the name of the official on
4whose behalf the expenditure was made, the name of the client
5if the expenditure was made on behalf of a client, the total
6amount of the expenditure, a description of the expenditure,
7the vendor or purveyor to whom the expenditure was made
8(including the address or location of the expenditure), the
9date on which the expenditure occurred and the subject matter
10of the lobbying activity, if any. For those expenditures made
11on behalf of a client, if the client is a client registrant,
12the report shall also include the name and address of the
13client or clients of the client registrant or the official or
14officials on whose behalf the expenditure ultimately was made.
15Each expenditure required to be reported shall include all
16expenses made for or on behalf of an official or his or her
17immediate family member living with the official.
18    (b-1) The report shall include any change or addition to
19the client list information, required in Section 5 for
20registration, since the last report, including the names and
21addresses of all clients who retained the lobbying entity
22together with an itemized description for each client of the
23following: (1) lobbying regarding executive action, including
24the name of any executive agency lobbied and the subject
25matter; (2) lobbying regarding legislative action, including
26the General Assembly and any other agencies lobbied and the

1subject matter; and (3) lobbying regarding administrative
2action, including the agency lobbied and the subject matter.
3Registrants who made no reportable expenditures during a
4reporting period shall file a report stating that no
5expenditures were incurred.
6    (b-2) Expenditures attributable to lobbying officials
7shall be listed and reported according to the following
8categories:
9        (1) Travel and lodging on behalf of others, including,
10    but not limited to, all travel and living accommodations
11    made for or on behalf of State officials during sessions
12    of the General Assembly.
13        (2) Meals, beverages and other entertainment.
14        (3) Gifts (indicating which, if any, are on the basis
15    of personal friendship).
16        (4) Honoraria.
17        (5) Any other thing or service of value not listed
18    under categories (1) through (4), setting forth a
19    description of the expenditure. The category travel and
20    lodging includes, but is not limited to, all travel and
21    living accommodations made for or on behalf of State
22    officials in the State capital during sessions of the
23    General Assembly.
24    (b-3) Expenditures incurred for hosting receptions,
25benefits and other large gatherings held for purposes of
26goodwill or otherwise to influence executive, legislative or

1administrative action to which there are 25 or more State
2officials invited shall be reported listing only the total
3amount of the expenditure, the date of the event, and the
4estimated number of officials in attendance.
5    (b-5) Expenditures incurred for any registered lobbyist
6hosting fundraisers for a candidate for elected office or a
7Political Action Committee shall be reported, including all
8donations made, the name of the person who made the donation,
9and the amount of the donation.
10    (b-7) Matters excluded from reports. The following items
11need not be included in the report:
12        (1) Reasonable and bona fide expenditures made by the
13    registrant who is a member of a legislative or State study
14    commission or committee while attending and participating
15    in meetings and hearings of such commission or committee.
16        (2) Reasonable and bona fide expenditures made by the
17    registrant for personal sustenance, lodging, travel,
18    office expenses and clerical or support staff.
19        (3) Salaries, fees, and other compensation paid to the
20    registrant for the purposes of lobbying.
21        (4) Any contributions required to be reported under
22    Article 9 of the Election Code.
23        (5) Expenditures made by a registrant on behalf of an
24    official that are returned or reimbursed prior to the
25    deadline for submission of the report.
26    (c) A registrant who terminates employment or duties which

1required him to register under this Act shall give the
2Secretary of State, within 30 days after the date of such
3termination, written notice of such termination and shall
4include therewith a report of the expenditures described
5herein, covering the period of time since the filing of his
6last report to the date of termination of employment. Such
7notice and report shall be final and relieve such registrant
8of further reporting under this Act, unless and until he later
9takes employment or assumes duties requiring him to again
10register under this Act.
11    (d) Failure to file any such report within the time
12designated or the reporting of incomplete information shall
13constitute a violation of this Act.
14    A registrant shall preserve for a period of 2 years all
15receipts and records used in preparing reports under this Act.
16    (e) Within 30 days after a filing deadline or as provided
17by rule, the lobbyist shall notify each official on whose
18behalf an expenditure has been reported. Notification shall
19include the name of the registrant, the total amount of the
20expenditure, a description of the expenditure, the date on
21which the expenditure occurred, and the subject matter of the
22lobbying activity.
23    (f) A report for the period beginning January 1, 2010 and
24ending on June 30, 2010 shall be filed no later than July 15,
252010, and a report for the period beginning July 1, 2010 and
26ending on December 31, 2010 shall be filed no later than

1January 15, 2011. Beginning January 1, 2011, reports shall be
2filed semi-monthly as follows: (i) for the period beginning
3the first day of the month through the 15th day of the month,
4the report shall be filed no later than the 20th day of the
5month and (ii) for the period beginning on the 16th day of the
6month through the last day of the month, the report shall be
7filed no later than the 5th day of the following month. A
8report filed under this Act is due in the Office of the
9Secretary of State no later than the close of business on the
10date on which it is required to be filed.
11    (g) All reports filed under this Act shall be filed in a
12format or on forms prescribed by the Secretary of State.
