SYNOPSIS AS INTRODUCED:
 

 
70 ILCS 5/2.7.3 new
70 ILCS 1865/Act rep.

     Amends the Airport Authorities Act. Creates the Northern Illinois Airport Authority within Lake County with the primary purpose of continuing to maintain, develop, and
operate the Waukegan National Airport and the Waukegan Marina and Harbor. Provides that the Authority is established 30 days after the appointment of board members to the board of commissioners of the Authority and certification by the Secretary of State. Provides that the Waukegan Port District is dissolved upon the establishment of the Authority with the Authority assuming the rights to all property, assets, and liabilities of the Waukegan Port District. Repeals the Waukegan Port District Act.

1    AN ACT concerning local government.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Airport Authorities Act is amended  by 
5adding Section 2.7.3 as follows:
 
6    (70 ILCS 5/2.7.3 new)
7    Sec. 2.7.3. Northern Illinois Airport Authority.
8    (a) The Northern Illinois Airport Authority is hereby 
9established
for the primary purpose of continuing to maintain, 
10develop, and
operate the Waukegan National Airport and the 
11Waukegan Marina and Harbor, the territory of which shall 
12include all of the territory within the corporate limits of 
13Lake County.  Within 30 days after the initial appointments 
14have been made under subsection (c) of this Section, the 
15Authority board shall notify the office of the Secretary of 
16State of the establishment of the Northern Illinois Airport 
17Authority, and the Secretary of State shall issue a 
18certificate of incorporation to the Authority.  Upon the 
19issuance of a certificate of
incorporation, the Northern 
20Illinois Airport Authority shall be deemed an organized 
21airport authority under this Act.
22    (b) The Waukegan Port District established under the 
23Waukegan Port District Act is dissolved upon the establishment

1of the Northern Illinois Airport Authority under this 
2amendatory Act of the 102nd General Assembly.  The rights to 
3all property, assets, and liabilities, including bonded 
4indebtedness, and the duties of the Waukegan Port District 
5shall be assumed by the Northern Illinois Airport Authority on 
6the effective date of this amendatory Act of the 102nd General 
7Assembly.
8    (c) The Board of Commissioners of the Northern Illinois 
9Airport Authority shall consist of commissioners residing 
10within Lake County, appointed as follows:
11        (1)  The members of the Board of the Waukegan Port 
12    District referenced in subsection (b) of this Section 
13    shall, upon establishment of the Northern Illinois Airport 
14    Authority, be deemed to be appointed to the initial Board 
15    of Commissioners of the Northern Illinois Airport 
16    Authority to serve their remaining terms of office.
17        (2)  The successors to the four commissioners appointed 
18    by the mayor of the City of Waukegan under the Waukegan 
19    Port District Act shall be appointed by the county board 
20    chairman of Lake County for six-year terms.
21        (3)  The successors to the three commissioners 
22    appointed by the Governor under the Waukegan Port District 
23    Act shall be appointed by the mayor of the City of Waukegan 
24    for six-year terms.
