SYNOPSIS AS INTRODUCED:
 
430 ILCS 15/8 new

    Amends the Gasoline Storage Act. Provides that, notwithstanding any other provision of the Act, and to the fullest extent allowable under the law, all motor vehicle fuel storage and dispensing equipment that is currently permitted for storage and dispensing of gasoline-ethanol blends containing 10% ethanol (E10) shall be permitted to store and dispense gasoline-ethanol blends containing 15% ethanol (E15), as long as the facility complies with all other requirements or rules of the Office of the State Fire Marshal. Provides that the Office of the State Fire Marshal, or any other State or local authority with jurisdiction over the E10-permitted equipment, shall not have the authority to prohibit storage or dispensing of E15 or deny a permit to a facility on the grounds that the motor vehicle fuel storage and dispensing equipment is not compatible for use with E15 if is approved or permitted to use with E10. Defines "motor vehicle fuel storage and dispensing equipment".

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Gasoline Storage Act is amended by adding
5Section 8 as follows:
 
6    (430 ILCS 15/8 new)
7    Sec. 8. Motor vehicle fuel storage and dispensing
8equipment; E10 and E15.
9    (a) Notwithstanding any other provision of this Act, and
10to the fullest extent allowable under the law, all motor
11vehicle fuel storage and dispensing equipment that is
12currently permitted for storage and dispensing of
13gasoline-ethanol blends containing 10% ethanol (E10) shall be
14permitted to store and dispense gasoline-ethanol blends
15containing 15% ethanol (E15), as long as the facility complies
16with all other requirements or rules of the Office of the State
17Fire Marshal. Upon request from a facility, the Office of the
18State Fire Marshal shall amend the facility's permit to state
19that E15 storage and dispensing in the existing motor vehicle
20fuel storage and dispensing equipment is permitted. However,
21no such permit amendment is necessary to allow a facility to
22commence E15 storing and dispensing in E10-permitted
23equipment. The Office of the State Fire Marshal, or any other

1State or local authority with jurisdiction over the
2E10-permitted equipment, shall not have the authority to
3prohibit storage or dispensing of E15 or deny a permit to a
4facility on the grounds that the motor vehicle fuel storage
5and dispensing equipment is not compatible for use with E15 if
6is approved or permitted to use with E10.
7    (b) In this Section, "motor vehicle fuel storage and
8dispensing equipment" means underground storage tanks and
9related components, piping, motor fuel dispensing equipment,
10including, but not limited to, nozzles, hoses, and fittings,
11and other equipment utilized in the storage, distribution, or
12dispensing of gasoline products.
