SYNOPSIS AS INTRODUCED:
 
720 ILCS 5/19-2.1 new

    Amends the Criminal Code of 2012. Creates the offense of possession of a relay vehicle theft device. Provides that a person commits the offense when he or she knowingly possesses a relay vehicle theft device. Exempts from a violation: (1) an employee of a facility subject to the Automotive Repair Act or the Automotive Collision Repair Act; (2) a new vehicle dealer or used vehicle dealer licensed under the Illinois Vehicle Code; (3) a locksmith licensed under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004; (4) a repossession agent; or (5) a federal, State, or local law enforcement officer. Provides that possession of a relay vehicle theft device is a Class 3 felony. Defines "relay vehicle theft device". Effective immediately.

1    AN ACT concerning criminal law.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Criminal Code of 2012 is amended by adding
5Section 19-2.1 as follows:
 
6    (720 ILCS 5/19-2.1 new)
7    Sec. 19-2.1. Possession of a relay vehicle theft device.
8    (a) In this Section, "relay vehicle theft device" means a
9device designed to capture a signal from the key fob of a motor
10vehicle to unlock and start the motor vehicle without the use
11or possession of the motor vehicle key.
12    (b) A person commits possession of a relay vehicle theft
13device when he or she knowingly possesses a relay vehicle
14theft device.
15    (c) This Section does not apply to:
16        (1) an employee of a facility subject to the
17    Automotive Repair Act or the Automotive Collision Repair
18    Act;
19        (2) a new vehicle dealer or used vehicle dealer
20    licensed under Section 5-101 or 5-102 of the Illinois
21    Vehicle Code;
22        (3) a locksmith licensed under the Private Detective,
23    Private Alarm, Private Security, Fingerprint Vendor, and

1    Locksmith Act of 2004;
2        (4) a repossession agent; or
3        (5) a federal, State, or local law enforcement
4    officer.
5    (d) Sentence. Possession of a relay vehicle theft device
6is a Class 3 felony.
 
7    Section 99. Effective date. This Act takes effect upon
8becoming law.
