Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that a local public entity is not liable for the bodily injury or death of a driver or passenger in a stolen vehicle if the plaintiff was, during the course of the alleged negligence, in flight or fleeing apprehension during the commission of the offense of fleeing or attempting to elude a peace officer or aggravated fleeing or attempting to elude a peace officer. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Local Governmental and Governmental |
5 | | Employees Tort
Immunity Act is amended by adding Section |
6 | | 2-109.5 as follows: |
7 | | (745 ILCS 10/2-109.5 new) |
8 | | Sec. 2-109.5. Injury or death caused by fleeing or |
9 | | attempting to elude peace officer in stolen vehicle. A local |
10 | | public entity is not liable for the bodily injury or death of a |
11 | | driver or passenger in a stolen vehicle if the plaintiff was, |
12 | | during the course of the alleged negligence, in flight or |
13 | | fleeing apprehension during the commission of the offense of |
14 | | fleeing or attempting to elude a peace officer or aggravated |
15 | | fleeing or attempting to elude a peace officer.

16 | | Section 99. Effective date. This Act takes effect upon |
17 | | becoming law.
