SYNOPSIS AS INTRODUCED:
 
40 ILCS 5/8-180.3 new
30 ILCS 805/8.46 new

    Amends the Chicago Municipal Article of the Illinois Pension Code. Provides that an employee of the Board of Education of the city, regardless of his or her position, may establish service credit in the Fund for part-time employment with the Board of Education of the city prior to becoming an employee by applying and paying a specified amount to the Fund. Provides that service credit shall not be granted for prior employment for which the applicant received credit under any other provision of the Code or during which the applicant was on a leave of absence. Amends the State Mandates Act to require implementation without reimbursement. Effective July 1, 2022.

1    AN ACT concerning public employee benefits.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Pension Code is amended by adding
5Section 8-180.3 as follows:
 
6    (40 ILCS 5/8-180.3 new)
7    Sec. 8-180.3. Credit for service as a part-time employee
8of the Board of Education of the city. An employee of the Board
9of Education of the city, regardless of his or her position,
10may establish service credit in the Fund for part-time
11employment with the Board of Education of the city prior to
12becoming an employee by applying and paying to the Fund for
13that employment an amount equal to the (1) employee
14contributions based on the actual compensation received and
15the rate of contribution in effect on the date of payment; plus
16(2) an amount representing employer contributions determined
17by the retirement board; plus (3) interest at the effective
18rate from the date of service to the date of payment. However,
19service credit shall not be granted under this Section for any
20such prior employment for which the applicant received credit
21under any other provision of this Code or during which the
22applicant was on a leave of absence.

1    Section 90. The State Mandates Act is amended by adding
2Section 8.46 as follows:
 
3    (30 ILCS 805/8.46 new)
4    Sec. 8.46. Exempt mandate. Notwithstanding Sections 6 and
58 of this Act, no reimbursement by the State is required for
6the implementation of any mandate created by this amendatory
7Act of the 102nd General Assembly.
 
8    Section 99. Effective date. This Act takes effect July 1,
92022.
