Creates the Renewable Energy Component Recycling Task Force Act. Creates the Renewable Energy Component Recycling Task Force to investigate options for recycling and other end of life management methods for renewable energy generation components and energy storage devices in accordance with State and federal requirements, to identify preferred methods to safely and responsibly manage end of life renewable energy generating components and energy storage devices, including the reuse or refurbishment, and other specified duties. Provides for the membership and duties of the Task Force. Directs the Task Force to report its findings and recommendations to the Governor and the General Assembly by March 1, 2023. Provides legislative findings. Repeals the Act on December 31, 2023. Effective immediately.

1 | | AN ACT concerning State government.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 1. Short title. This Act may be cited as the |
5 | | Renewable Energy Component Recycling Task Force Act. |
6 | | Section 5. Findings. The General Assembly finds that:
|
7 | | (1) Renewable energy is a critical component of the |
8 | | State's transition to 100% clean energy by 2050. |
9 | | (2) The State has made it a priority to catalyze the |
10 | | development of wind and solar generated electricity and |
11 | | energy storage systems through various incentive programs. |
12 | | (3) Wind and solar electric generating equipment and |
13 | | energy storage systems have a limited economically |
14 | | productive lifespan. |
15 | | (4) At the end of life of a wind turbine, solar panel, |
16 | | or energy storage system, there are a number of recyclable |
17 | | components including various raw materials. |
18 | | (5) The State should develop an end of life plan to |
19 | | recycle the components of renewable energy generating |
20 | | equipment and energy storage equipment to avoid pollution |
21 | | and material waste. |
22 | | Section 10. The Renewable Energy Component Recycling Task |

1 | | Force.
|
2 | | (a) The Renewable Energy Component Recycling Task Force, |
3 | | hereinafter referred to as the REC Recycling Task Force, is |
4 | | hereby established.
|
5 | | (b) The REC Recycling Task Force shall consist of the |
6 | | following members:
|
7 | | (1) The Director of the Environmental Protection |
8 | | Agency or his or her designee;
|
9 | | (2) The Chair of the Illinois Commerce Commission or |
10 | | his or her designee;
|
11 | | (3) The Director of the Illinois Power Agency or his |
12 | | or her designee;
|
13 | | (4) Four members appointed by the Governor, including |
14 | | one representing a solid waste disposal organization, one |
15 | | representing a renewable energy organization, and one |
16 | | representing an environmental advocacy organization;
|
17 | | (5) Two members appointed by the President of the |
18 | | Senate, one representing a solid waste disposal |
19 | | organization and one representing a renewable energy |
20 | | organization;
|
21 | | (6) Two members appointed by the Minority Leader of |
22 | | the Senate, one representing a solid waste disposal |
23 | | organization and one representing a renewable energy |
24 | | organization;
|
25 | | (7) Two members appointed by the Speaker of the House |
26 | | of Representatives, one representing a solid waste |

1 | | disposal organization and one representing a renewable |
2 | | energy organization; and
|
3 | | (8) Two members appointed by the Minority Leader of |
4 | | the House of Representatives, one representing a solid |
5 | | waste disposal organization and one representing a |
6 | | renewable energy organization.
|
7 | | (c) The REC Recycling Task Force shall meet at the call of |
8 | | the Chair at least quarterly to fulfill its duties under this |
9 | | Act. At the first meeting of the REC Recycling Task Force, the |
10 | | Task Force shall elect from among its members a Chair and such |
11 | | other officers as it may choose.

12 | | (d) The Environmental Protection Agency shall provide |
13 | | administrative support to the REC Recycling Task Force.
|
14 | | (e) Members of the REC Recycling Task Force shall serve |
15 | | without compensation but the Task Force may, within the limits |
16 | | of any funds appropriated or otherwise made available to it, |
17 | | reimburse its members for actual and necessary expenses |
18 | | incurred in the discharge of their Task Force duties. |
19 | | Section 15. Duties and report.

20 | | (a) The REC Recycling Task Force shall have the following |
21 | | duties:
|
22 | | (1) Investigate options for recycling and other end of |
23 | | life management methods for renewable energy generation |
24 | | components and energy storage devices in accordance with |
25 | | State and federal requirements.

1 | | (2) Identify preferred methods to safely and |
2 | | responsibly manage end of life renewable energy generating |
3 | | components and energy storage devices, including the reuse |
4 | | or refurbishment. |
5 | | (3) Consider the economic and environmental costs and |
6 | | benefits associated with each method of recycling or end |
7 | | of life management identified. |
8 | | (4) Project the economically productive life cycle of |
9 | | various types of renewable energy generating equipment and |
10 | | energy storage systems currently in use or planned for |
11 | | development in this State and model the impact that may be |
12 | | expected to the State's landfill capacity if landfill |
13 | | disposal is permitted for all such equipment and storage |
14 | | systems at end of life. |
15 | | (5) Survey federal and other states' and countries' |
16 | | regulatory requirements relating to the end of life |
17 | | management, decommissioning, and financial assurance |
18 | | requirements for owners, operators, developers, and |
19 | | manufacturers of renewable energy generation components |
20 | | and energy storage systems.

21 | | (6) Identify infrastructure that may be needed to |
22 | | develop a practical, effective, and cost-efficient means |
23 | | to collect and transport end of life renewable generation |
24 | | components and energy storage systems in State for reuse, |
25 | | refurbishment, recycling, or disposal. |
26 | | (7) Receive stakeholder engagement and feedback on |

1 | | various recycling and end of life management proposals for |
2 | | renewable energy generation components and energy storage |
3 | | systems. |
4 | | (8) Develop recommendations for legislative, |
5 | | administrative, or private sector action to implement |
6 | | recycling and end of life management for renewable energy |
7 | | generation components and energy storage systems.

8 | | (b) The REC Recycling Task Force shall submit a final |
9 | | report on activities conducted pursuant to this Act with |
10 | | findings, including stakeholder input, to the General Assembly |
11 | | and the Governor's Office no later than March 1, 2023.
|
12 | | Section 20. Repealer. This Act is repealed on December 31, |
13 | | 2023.
|
14 | | Section 99. Effective date. This Act takes effect upon |
15 | | becoming law.
