| 1 | | Force.
|
| 2 | | (a) The Renewable Energy Component Recycling Task Force, |
| 3 | | hereinafter referred to as the REC Recycling Task Force, is |
| 4 | | hereby established.
|
| 5 | | (b) The REC Recycling Task Force shall consist of the |
| 6 | | following members:
|
| 7 | | (1) The Director of the Environmental Protection |
| 8 | | Agency or his or her designee;
|
| 9 | | (2) The Chair of the Illinois Commerce Commission or |
| 10 | | his or her designee;
|
| 11 | | (3) The Director of the Illinois Power Agency or his |
| 12 | | or her designee;
|
| 13 | | (4) Four members appointed by the Governor, including |
| 14 | | one representing a solid waste disposal organization, one |
| 15 | | representing a renewable energy organization, and one |
| 16 | | representing an environmental advocacy organization;
|
| 17 | | (5) Two members appointed by the President of the |
| 18 | | Senate, one representing a solid waste disposal |
| 19 | | organization and one representing a renewable energy |
| 20 | | organization;
|
| 21 | | (6) Two members appointed by the Minority Leader of |
| 22 | | the Senate, one representing a solid waste disposal |
| 23 | | organization and one representing a renewable energy |
| 24 | | organization;
|
| 25 | | (7) Two members appointed by the Speaker of the House |
| 26 | | of Representatives, one representing a solid waste |

| 1 | | disposal organization and one representing a renewable |
| 2 | | energy organization; and
|
| 3 | | (8) Two members appointed by the Minority Leader of |
| 4 | | the House of Representatives, one representing a solid |
| 5 | | waste disposal organization and one representing a |
| 6 | | renewable energy organization.
|
| 7 | | (c) The REC Recycling Task Force shall meet at the call of |
| 8 | | the Chair at least quarterly to fulfill its duties under this |
| 9 | | Act. At the first meeting of the REC Recycling Task Force, the |
| 10 | | Task Force shall elect from among its members a Chair and such |
| 11 | | other officers as it may choose.

| 12 | | (d) The Environmental Protection Agency shall coordinate |
| 13 | | meetings for and provide other logistical assistance to the |
| 14 | | REC Recycling Task Force. The Agency may, upon request by the |
| 15 | | Task Force, arrange to have outside experts provide research |
| 16 | | assistance, technical support, and assistance in the |
| 17 | | preparation of reports for the REC Recycling Task Force. |
| 18 | | Notwithstanding any law to the contrary, the Environmental |
| 19 | | Protection Agency may use moneys from the Solid Waste |
| 20 | | Management Fund to fulfill its obligations under this Section, |
| 21 | | including any obligation it may have to arrange to have |
| 22 | | outside experts provide support and assistance to the Task |
| 23 | | Force pursuant to this subsection. |
| 24 | | (e) Members of the REC Recycling Task Force shall serve |
| 25 | | without compensation but the Task Force may, within the limits |
| 26 | | of any funds appropriated or otherwise made available to it, |

| 1 | | reimburse its members for actual and necessary expenses |
| 2 | | incurred in the discharge of their Task Force duties. |
| 3 | | Section 15. Duties and report.
|
| 4 | | (a) The REC Recycling Task Force shall have the following |
| 5 | | duties:
|
| 6 | | (1) Investigate options for recycling and other end of |
| 7 | | life management methods for renewable energy generation |
| 8 | | components and energy storage devices in accordance with |
| 9 | | State and federal requirements.
|
| 10 | | (2) Identify preferred methods to safely and |
| 11 | | responsibly manage end of life renewable energy generating |
| 12 | | components and energy storage devices, including the reuse |
| 13 | | or refurbishment. |
| 14 | | (3) Consider the economic and environmental costs and |
| 15 | | benefits associated with each method of recycling or end |
| 16 | | of life management identified. |
| 17 | | (4) Project the economically productive life cycle of |
| 18 | | various types of renewable energy generating equipment and |
| 19 | | energy storage systems currently in use or planned for |
| 20 | | development in this State and model the impact that may be |
| 21 | | expected to the State's landfill capacity if landfill |
| 22 | | disposal is permitted for all such equipment and storage |
| 23 | | systems at end of life. |
| 24 | | (5) Survey federal and other states' and countries' |
| 25 | | regulatory requirements relating to the end of life |

| 1 | | management, decommissioning, and financial assurance |
| 2 | | requirements for owners, operators, developers, and |
| 3 | | manufacturers of renewable energy generation components |
| 4 | | and energy storage systems.
|
| 5 | | (6) Identify infrastructure that may be needed to |
| 6 | | develop a practical, effective, and cost-efficient means |
| 7 | | to collect and transport end of life renewable generation |
| 8 | | components and energy storage systems in State for reuse, |
| 9 | | refurbishment, recycling, or disposal. |
| 10 | | (7) Receive stakeholder engagement and feedback on |
| 11 | | various recycling and end of life management proposals for |
| 12 | | renewable energy generation components and energy storage |
| 13 | | systems. |
| 14 | | (8) Develop recommendations for legislative, |
| 15 | | administrative, or private sector action to implement |
| 16 | | recycling and end of life management for renewable energy |
| 17 | | generation components and energy storage systems.
|
| 18 | | (b) The REC Recycling Task Force shall submit a final |
| 19 | | report on activities conducted pursuant to this Act with |
| 20 | | findings, including stakeholder input, to the General Assembly |
| 21 | | and the Governor's Office no later than July 1, 2025.
|
| 22 | | Section 20. Repealer. This Act is repealed on December 31, |
| 23 | | 2025.
|
| 24 | | Section 99. Effective date. This Act takes effect upon |
| 25 | | becoming law.
