| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Department of Human Services Act is amended |
| 5 | | by changing Section 1-20 as follows:
|
| 6 | | (20 ILCS 1305/1-20)
|
| 7 | | Sec. 1-20. General powers and duties.
|
| 8 | | (a) The
The Department shall exercise the rights, powers, |
| 9 | | duties, and functions
provided by law, including (but not |
| 10 | | limited to) the rights, powers, duties, and
functions |
| 11 | | transferred to the Department under Article 80 and Article 90 |
| 12 | | of this
Act. |
| 13 | | (b) The Department may employ personnel (in accordance |
| 14 | | with the Personnel
Code), provide facilities, contract for |
| 15 | | goods and services, and adopt rules as
necessary to carry out |
| 16 | | its functions and purposes, all in accordance with
applicable |
| 17 | | State and federal law.

| 18 | | (c) On and after the date 6 months after the effective date |
| 19 | | of this amendatory Act of the 98th General Assembly, as |
| 20 | | provided in the Executive Order 1 (2012) Implementation Act, |
| 21 | | all of the powers, duties, rights, and responsibilities |
| 22 | | related to State healthcare purchasing under this Act that |
| 23 | | were transferred from the Department to the Department of |
