SENATE RESOLUTION

 
2    WHEREAS, On May 31, 2019, the 101st General Assembly
3passed the Reproductive Health Act, which established laws and
4policies that protect individual decision-making in the area
5of reproductive health, supports access to the full scope of
6quality reproductive health care for all in our State, and
7permits regulation of reproductive health care, including
8contraception, abortion, and maternity care, only to the
9extent that such regulation is narrowly tailored to protect a
10compelling State interest; and
 
11    WHEREAS, Each individual has a fundamental right to make
12autonomous decisions about one's own reproductive health,
13including the fundamental right to use or refuse reproductive
14health care, contraception, or sterilization and to make
15autonomous decisions about how to exercise that right and the
16fundamental right of an individual who becomes pregnant to
17continue the pregnancy and give birth to a child or to have an
18abortion and to make autonomous decisions about how to
19exercise that right; and
 
20    WHEREAS, The Reproductive Health Act repealed the Illinois
21Abortion Law of 1975, the Partial-birth Abortion Ban Act, and
22the Abortion Performance Refusal Act; and

1    WHEREAS, The Governor approved of the Reproductive Health
2Act, and it became law on June 12, 2019; and
 
3    WHEREAS, On May 17, 2021, the United States Supreme Court
4granted the petition for writ of certiorari to Dobbs v.
5Jackson Women's Health Organization on Question 1 that is
6whether all pre-viability prohibitions on elective abortions
7are unconstitutional; and
 
8    WHEREAS, In the wake of this news, fundamental
9reproductive health rights and the United States
10constitutional right to abortion established by Roe v. Wade
11and Planned Parenthood v. Casey are in jeopardy; and
 
12    WHEREAS, In 2021, several states are banning fundamental
13reproductive health rights across the nation; therefore, be it
 
14    RESOLVED, BY THE SENATE OF THE ONE HUNDRED SECOND GENERAL
15ASSEMBLY OF THE STATE OF ILLINOIS, that we declare our
16commitment to uphold the law and values embodied within the
17Reproductive Health Act; and be it further
 
18    RESOLVED, That suitable copies of this resolution be
19delivered to the Governor, all Illinois constitutional
20officers, and all members of the Illinois General Assembly in
21order to bring further awareness to the importance of

1upholding fundamental reproductive health rights for our
2residents of the State of Illinois and to be a model state for
3the rest of our country.
