AMENDMENT TO HOUSE BILL 793

2    AMENDMENT NO. ______. Amend House Bill 793, AS AMENDED,
3with reference to page and line numbers of House Amendment No.
41, on page 3, by replacing lines 8 and 9 with "those noted in
5this Act, shall result in a complete phase out of Illinois";
6and
 
7on page 3, line 15, by replacing "Elimination of" with
8"Voluntary cessation of the use of"; and
 
9on page 3, line 21, by replacing "eliminate on July 1, 2027"
10with "voluntarily cease"; and
 
11on page 4, line 8, by replacing "Department" with "Department
12of Human Services"; and
 
13on page 4, immediately below line 19, by inserting:
14    "(b) Moneys in this Fund shall be disbursed only for the

1purposes of this Section but not before July 1, 2027. No
2disbursement may be made from the Fund until after the
3Department of Labor certifies that: (i) the named recipient of
4the disbursement is eligible to receive the stated sum of
5money; (ii) the disbursement is made for the purposes and
6objectives of this Section; and (iii) the recipient can
7transition away from providing subminimum wage employment by
8January 1, 2030 to employment compensated at the federal
9minimum wage or the State minimum wage.
10    (c) For the purposes of subsection (b) of Section 5 of the
11State Finance Act, the Fund shall be discontinued on July 1,
122030."; and
 
13on page 4, line 20, by replacing "(b)" with "(d)"; and
 
14on page 4, line 24, after "amended", by inserting "by changing
15Section 10 and"; and
 
16on page 5, immediately below line 1, by inserting the
17following:
 
18    "(20 ILCS 4095/10)
19    Sec. 10. Employment and Economic Opportunity for Persons
20with Disabilities Task Force.
21    (a) The Employment and Economic Opportunity for Persons
22with Disabilities Task Force is created.

1    (b) The Employment and Economic Opportunity for Persons
2with Disabilities Task Force shall be appointed and hold its
3first meeting within 90 days after the effective date of this
4Act, be convened by the Governor, and operate with
5administrative support from the Illinois Department of Human
6Services.
7    (c) The Task Force shall be comprised of the following
8representatives of State Government: a high-ranking member of
9the Governor's management team, designated by the Governor;
10representatives of each division of the Department of Human
11Services, designated by the Secretary of Human Services; the
12Director of Healthcare and Family Services, or his or her
13designee; the Director of Veterans' Affairs or his or her
14designee; the Director of Commerce and Economic Opportunity or
15his or her designee; the Director of Employment Security or
16his or her designee; the Director of Central Management
17Services or his or her designee; the Director of Juvenile
18Justice or his or her designee; the Executive Director of the
19Board of Higher Education or his or her designee; the
20Executive Director of the Illinois Community College Board or
21his or her designee; the Executive Director of the Illinois
22Council on Developmental Disabilities or his or her designee;
23and the State Superintendent of Education or his or her
24designee.
25    (d) The Task Force shall also consist of no more than 15
26public members who shall be appointed by the Governor and who

1represent the following constituencies: statewide
2organizations that advocate for persons with physical,
3developmental and psychiatric disabilities, entities with
4expertise in assistive technology devices and services for
5persons with disabilities, advocates for veterans with
6disabilities, centers for independent living, disability
7services providers, organized labor, higher education, the
8private sector business community, entities that provide
9employment and training services to persons with disabilities,
10and at least 5 persons who have a disability.
11    (d-5) The Task Force shall consist of 4 members from the
12General Assembly, one each appointed by the Speaker of the
13House of Representatives, the Minority Leader of the House of
14Representatives, the President of the Senate, and the Minority
15Leader of the Senate.
16    (e) The Task Force shall be co-chaired by the
17representative of the Governor and a public member who shall
18be chosen by the other public members of the Task Force.
19    (f) The Task Force members shall serve voluntarily and
20without compensation. Persons with disabilities serving on the
21Task Force shall be accommodated to enable them to fully
22participate in Task Force activities.
23    (g) The co-chairs of the Task Force shall extend an
24invitation to chairs and minority spokespersons of appropriate
25legislative committees to attend all meetings of the Task
26Force, and may invite other individuals who are not members of

1the Task Force to participate in subcommittees of the Task
2Force or to take part in discussions of topics for which those
3individuals have particular expertise.
4    (h) The Task Force shall coordinate its work with existing
5State advisory bodies whose work may include employment and
6economic opportunity for persons with disabilities.

9on page 5, line 8, by replacing "meets" with "meet"; and
 
10on page 8, by replacing lines 20 and 21 with the following:
 
11    "(30 ILCS 105/5.990 new)
12    Sec. 5.990. The 14(c) Transition Grant Fund. This Section
13is repealed on August 1, 2030."; and
 
14on page 25, lines 23 and 24, by deleting "This subsection (b)
15is inoperative on and after July 1, 2027."; and
 
16on page 27, by deleting lines 10 through 12.
