AMENDMENT TO HOUSE BILL 798

AMENDMENT NO. ______. Amend House Bill 798 by replacing everything after the enacting clause with the following:

"Section 1. This Act may be referred to as the Capitol Security and Safety Act.

Section 5. The Secretary of State Act is amended by adding Sections 5.1 and 5.2 as follows:

(15 ILCS 305/5.1 new)

Sec. 5.1. Installation of security devices in State Capitol Complex.

(a) Subject to appropriation, the Office of the Secretary of State, in collaboration with the Office of the Architect of the Capitol, shall install and maintain:

(1) safety call boxes in and around the State Capitol Complex, including parking lots and parking structures;

(2) identification card verification checkpoints at the entrance of secured areas in the State Capitol Complex; and

(3) hardened security posts in the State Capitol Complex where law enforcement personnel of the Secretary of State Police Department and other security personnel are stationed while on duty.

(b) As used in this Section:

"Hardened" means the strengthening of the security of a building, installation, or post in order to protect it in the event of attack or reduce risk of personal injury through means of installing or constructing temporary or permanent structures.

"Identification card verification checkpoint" means equipment and related software that allows an individual who holds an identification card that grants that individual with access to a secured part of the State Capitol Complex to scan the identification card to pass through a checkpoint.

"Safety call box" means a well lit, publicly accessible call box that houses a telecommunication device that may be used by an individual who feels unsafe and who wishes to communicate with law enforcement authorities and alert those authorities of the individual's location.

Sec. 5.2. Rules for security measures in State Capitol Complex. The Secretary of State shall adopt rules to:

(1) Establish a chain of command based in Springfield for police and other security personnel responding to an incident at the State Capitol Complex.

(2) Authorize administrative personnel based in Springfield to issue emergency orders in response to an incident at the State Capitol Complex.

(3) Provide adequate mitigation and response training to law enforcement personnel of the Secretary of State Police Department and other security personnel who are stationed at the State Capitol Complex.

(4) Create a voluntary training program to allow security personnel employed by the Secretary of State to successfully complete firearm training and qualify to carry firearms only while on duty at the State Capitol Complex and provide incentive compensation to all trained and qualified individuals. The procedures established under this paragraph shall require that all firearms issued to trained and qualified security personnel, other than law enforcement personnel of the Secretary of State Police Department, shall be returned to designated and secured storage areas in the State Capitol Complex at the end of each duty shift.

(5) Adopt and enforce improved security procedures for legislators, staff, lobbyists, and visitors entering the State Capitol Complex, including procedures to allow law enforcement personnel of the Secretary of State Police Department and other security personnel to perform additional screening on any individual seeking to enter a secured area at the discretion of the law enforcement personnel or security personnel.

Section 99. Effective date. This Act takes effect upon becoming law.".
