SYNOPSIS AS INTRODUCED:

50 ILCS 705/8  from Ch. 85, par. 508

    Amends the Illinois Police Training Act. Provides that the Illinois Law Enforcement Training Standards Board, police training schools approved by the Board, law enforcement agencies, and units of local government may not initiate, administer, or conduct training programs that include warrior-style training, either directly or through a third party. Provides that the Board may not reimburse a law enforcement agency or unit of local government for any portion of training programs that include warrior-style training. Provides that law enforcement agencies and units of local government may not indemnify or otherwise provide liability protection for a peace officer for liability arising from the use of tactics derived from warrior-style training. Defines "warrior-style" training. Preempts home rule. Amends the Illinois State Police Law of the Civil Administrative Code of Illinois to make conforming changes.

1    AN ACT concerning police training.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois State Police Law of the Civil
5Administrative Code of Illinois is amended by adding Section
62605-56 as follows:
 
7    (20 ILCS 2605/2605-56 new)
8    Sec. 2605-56. Warrior-style training prohibited.
9    (a) The Illinois State Police shall not initiate,
10administer, or conduct training programs that include
11warrior-style training.
12    (b) Notwithstanding any provision of law to the contrary
13including, but not limited to, the State Employee
14Indemnification Act, the Illinois State Police may not
15indemnify or otherwise provide liability protection for an
16Illinois State Police trooper, police officer, investigator,
17or other employee exercising the powers of a peace officer for
18liability arising from the use of tactics derived from
19warrior-style training.
20    (c) In this Section, "warrior-style training" means
21training for Illinois State Police troopers, police officers,
22investigators, or other employees exercising the powers of a
23peace officer that dehumanizes people or encourages aggressive

1conduct by peace officers during encounters with others in a
2manner that de-emphasizes the value of human life or
3constitutional rights, the result of which increases a peace
4officer's likelihood or willingness to use deadly force.
 
5    Section 10. The Illinois Police Training Act is amended by
6changing Section 8 and by adding Section 7.1 as follows:
 
7    (50 ILCS 705/7.1 new)
8    Sec. 7.1. Warrior-style training prohibited.
9    (a) The Board shall not initiate, administer, or conduct
10training programs that include warrior-style training. The
11curriculum approved by the Board for probationary police
12officers to be offered by all certified schools shall not
13include warrior-style training.
14    (b) No police training school or local governmental agency
15shall provide warrior-style training.
16    (c) The Board may not reimburse a law enforcement agency
17or a peace officer for any part of a course or other training
18that includes warrior-style training.
19    (d) A law enforcement agency may not provide warrior-style
20training, directly or through a third party, to a peace
21officer.
22    (e) Notwithstanding any provision of law to the contrary
23including, but not limited to, the Local Governmental and
24Governmental Employees Tort Immunity Act and Sections 1-4-5

1and 1-4-6 of the Illinois Municipal Code, no local government
2agency may indemnify or otherwise provide liability protection
3for a peace officer for liability arising from the use of
4tactics derived from warrior-style training.
5    (f) In this Section, "warrior-style training" means
6training for peace officers that dehumanizes people or
7encourages aggressive conduct by peace officers during
8encounters with others in a manner that de-emphasizes the
9value of human life or constitutional rights, the result of
10which increases a peace officer's likelihood or willingness to
11use deadly force.

13    Sec. 8. Participation required. All home rule local
14governmental units shall comply with Sections 6.3, 7.1, 8.1,
15and 8.2 and any other mandatory provisions of this Act. This
16Act is a limitation on home rule powers under subsection (i) of
17Section 6 of Article VII of the Illinois Constitution.
