| 1 | AN ACT concerning health.

| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:

| 4 | Section 5. The Illinois Food, Drug and Cosmetic Act is | |||||||||||||||||||
| 5 | amended by adding Section 17.3 as follows: | |||||||||||||||||||
| 6 | (410 ILCS 620/17.3 new) | |||||||||||||||||||
| 7 | Sec. 17.3. Cosmetic safety. | |||||||||||||||||||
| 8 | (a) It is the intent of the General Assembly to prohibit | |||||||||||||||||||
| 9 | the presence of intentionally added ingredients in cosmetics, | |||||||||||||||||||
| 10 | consistent with the European Union's prohibition on the | |||||||||||||||||||
| 11 | presence of intentionally added ingredients in cosmetics. | |||||||||||||||||||
| 12 | (b) In this Section, "ingredient" means any component of a | |||||||||||||||||||
| 13 | cosmetic product as that term is defined under 21 CFR 700.3. | |||||||||||||||||||
| 14 | (c) Beginning January 1, 2025, no person or entity shall | |||||||||||||||||||
| 15 | manufacture, sell, deliver, hold, or offer for sale in | |||||||||||||||||||
| 16 | commerce any cosmetic product that contains any of the | |||||||||||||||||||
| 17 | following intentionally added ingredients: | |||||||||||||||||||
| 18 | (1) Dibutyl phthalate (CAS no. 84-74-2). | |||||||||||||||||||
| 19 | (2) Diethylhexyl phthalate (CAS no. 117-81-7). | |||||||||||||||||||
| 20 | (3) Formaldehyde (CAS no. 50-00-0). | |||||||||||||||||||
| 21 | (4) Paraformaldehyde (CAS no. 30525-89-4). | |||||||||||||||||||
| 22 | (5) Methylene glycol (CAS no. 463-57-0). | |||||||||||||||||||
| 23 | (6) Quaternium-15 (CAS no. 51229-78-8). | |||||||||||||||||||

| |||||||
| 1 | (7) Mercury (CAS no. 7439-97-6). | ||||||
| 2 | (8) Isobutylparaben (CAS no. 4247-02-3). | ||||||

| 16 | (C) Diethanolamine perfluorooctane sulfonate (CAS | ||||||
| 17 | 70225-14-8). | ||||||
| 18 | (D) Ammonium perfluorooctane sulfonate or ammonium | ||||||
| 19 | heptadecafluorooctanesulfonate (CAS 29081-56-9). | ||||||

| 12 | (d) A cosmetic product is not in violation of this Section | ||||||
| 13 | if: | ||||||
| 14 | (1) the cosmetic product is made through manufacturing | ||||||
| 15 | processes that are intended to comply with this Section; | ||||||
| 16 | (2) the cosmetic product contains a technically | ||||||
| 17 | unavoidable trace quantity of an ingredient listed in | ||||||
| 18 | subsection (c); and | ||||||
| 19 | (3) the trace quantity stems from impurities of | ||||||
| 20 | natural or synthetic ingredients, the manufacturing | ||||||
| 21 | process, storage, or migration from packaging.
