410 ILCS 620/17.3 new

     Amends the Illinois Food, Drug and Cosmetic Act. Provides that, beginning January 1, 2025, no person or entity shall manufacture, sell, deliver, hold, or offer for sale in commerce any cosmetic product that contains specified intentionally added ingredients. Provides an exception to the prohibition. Contains other provisions.

1    AN ACT concerning health.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Illinois Food, Drug and Cosmetic Act is 
5amended  by adding Section 17.3 as follows:
 
6    (410 ILCS 620/17.3 new)
7    Sec. 17.3. Cosmetic safety.
8    (a)   It is the intent of the General Assembly to prohibit 
9the presence of intentionally added ingredients in cosmetics, 
10consistent with the European Union's prohibition on the 
11presence of intentionally added ingredients in cosmetics.
12    (b)   In this Section, "ingredient" means any component of a 
13cosmetic product as that term is defined under 21 CFR 700.3.
14    (c)   Beginning January 1, 2025, no person or entity shall 
15manufacture, sell, deliver, hold, or offer for sale in 
16commerce any cosmetic product that contains any of the 
17following intentionally added ingredients:
18        (1)   Dibutyl phthalate (CAS no. 84-74-2).
19        (2) Diethylhexyl phthalate (CAS no. 117-81-7).
20        (3) Formaldehyde (CAS no. 50-00-0).
21        (4) Paraformaldehyde (CAS no. 30525-89-4).
22        (5) Methylene glycol (CAS no. 463-57-0).
23        (6) Quaternium-15 (CAS no. 51229-78-8).

1        (7) Mercury (CAS no. 7439-97-6).
2        (8) Isobutylparaben (CAS no. 4247-02-3).
3        (9) Isopropylparaben (CAS no. 4191-73-5).
4        (10) m-Phenylenediamine and its salts (CAS no. 
5    108-45-2).
6        (11) o-Phenylenediamine and its salts (CAS no. 
7    95-54-5).
8        (12) The following per- and polyfluoroalkyl substances 
9    (PFAS) and their salts:
10            (A) Perfluorooctane sulfonate (PFOS) or 
11        heptadecafluorooctane-1-sulfonic acid (CAS no. 
12        1763-23-1).
13            (B) Potassium perfluorooctanesulfonate or 
14        potassium heptadecafluorooctane-1-sulfonate (CAS no. 
15        2795-39-3).
16            (C) Diethanolamine perfluorooctane sulfonate (CAS 
17        70225-14-8).
18            (D) Ammonium perfluorooctane sulfonate or ammonium 
19        heptadecafluorooctanesulfonate (CAS 29081-56-9).
20            (E) Lithium perfluorooctane sulfonate or lithium 
21        heptadecafluorooctanesulfonate (CAS 29457-72-5).
22            (F) Perfluorooctanoic acid (PFOA) (CAS no. 
23        335-67-1).
24            (G) Ammonium pentadecafluorooctanoate (CAS no. 
25        3825-26-1).
26            (H) Nonadecafluorodecanoic acid (CAS no.

1        355-76-2).
2            (I) Ammonium nonadecafluorodecanoate (CAS no. 
3        3108-42-7).
4            (J) Sodium nonadecafluorodecanoate (CAS no. 
5        3830-45-3).
6            (K) Perfluorononanoic acid (PFNA) (CAS no. 
7        375-95-1).
8            (L) Sodium heptadecafluorononanoate (CAS no. 
9        21049-39-8).
10            (M) Ammonium perfluorononanoate (CAS no. 
11        4149-60-4). 
12    (d) A cosmetic product is not in violation of this Section 
13if:
14        (1) the cosmetic product is made through manufacturing 
15    processes that are intended to comply with this Section;
16        (2) the cosmetic product contains a technically 
17    unavoidable trace quantity of an ingredient listed in 
18    subsection (c); and
19        (3) the trace quantity stems from impurities of 
20    natural or synthetic ingredients, the manufacturing 
21    process, storage, or migration from packaging.
