|
Amends the Illinois Commercial Feed Act of 1961. Provides that pet food and specialty pet food are misbranded if the label fails to disclose whether the pet food contains a major food allergen. Defines "major food allergen" as milk, eggs, fish, crustaceans, tree nuts, wheat, peanuts, soybeans, and food ingredients that contain protein derived from those foods.

| 1 | | AN ACT concerning agriculture.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Commercial Feed Act of 1961 is |
| 5 | | amended by changing Section 8 as follows:
|
| 6 | | (505 ILCS 30/8) (from Ch. 56 1/2, par. 66.8)

| 7 | | Sec. 8. Misbranding. A commercial feed or
customer-formula |
| 8 | | feed is misbranded:
|
| 9 | | (a) If its labeling is false or misleading in any |
| 10 | | particular.
|
| 11 | | (b) If it is distributed under the name of another |
| 12 | | commercial feed.
|
| 13 | | (c) If it is not labeled as required in Section 5 of this |
| 14 | | Act and in
regulations prescribed under this Act.
|
| 15 | | (d) If it purports to be or is represented as a commercial |
| 16 | | feed, or
if it purports to contain or is represented as |
| 17 | | containing a feed
ingredient, unless the feed ingredient |
| 18 | | conforms to the definition of
identity, if any, prescribed by |
| 19 | | the Association of
American Feed Control Officials, as adopted |
| 20 | | in Section 10 of this Act.

| 21 | | (e) If any word, statement or other information required |
| 22 | | by or under
authority of this Act to appear on the label or |
| 23 | | labeling is not
prominently placed thereon with such |
