SYNOPSIS AS INTRODUCED:

35 ILCS 200/15-190 new

Amends the Property Tax Code. Provides that no county employee or county official shall publicly disclose on an Internet website information concerning whether particular property has been granted a homestead exemption based on an individual's status as a person with a disability if the county receives a written request from the person with a disability or from that person's authorized agent or representative to refrain from disclosing that information. Provides that the information shall be removed from the Internet website within 5 business days after the request. Provides for an action in the circuit court seeking injunctive or declaratory relief to enforce the provisions of the amendatory Act.

A BILL FOR

AN ACT concerning revenue.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Property Tax Code is amended by adding Section 15-190 as follows:

Sec. 15-190. Limitations on posting disability status.

(a) No county employee or county official shall publicly disclose on an Internet website information concerning whether a particular property has been granted a homestead exemption under this Code based on an individual's status as a person with a disability if the county receives a written request to refrain from disclosing that information from the person with a disability or from that person's authorized agent or representative. Any publicly available information the disclosure of which is prohibited by this Section shall be removed from the Internet website within 5 business days after the county receives a written request under this Section. After the information has been removed, no county employee or county official shall publicly post or display the information described in this Section unless the county receives written authorization from the individual with a disability to make that information available to the public.

(b) A property owner whose homestead exemption status is publicly disclosed in violation of this Section may bring an action in the circuit court seeking injunctive or declaratory relief prohibiting disclosure of information concerning the individual's status as a person with a disability.
