1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6adding Section 2105-370 and 2105-375 as follows:
 
7    (20 ILCS 2105/2105-370 new)
8    Sec. 2105-370. Continuing education; cultural competency.
9    (a) As used in this Section:
10    "Cultural competency" means a set of integrated attitudes,
11knowledge, and skills that enables a health care professional
12or organization to care effectively for patients from diverse
13cultures, groups, and communities.
14    "Health care professional" means a person licensed or
15registered by the Department under the following Acts: the
16Medical Practice Act of 1987, the Nurse Practice Act, the
17Clinical Psychologist Licensing Act, the Illinois Optometric
18Practice Act of 1987, the Illinois Physical Therapy Act, the
19Pharmacy Practice Act, the Physician Assistant Practice Act of
201987, the Clinical Social Work and Social Work Practice Act,
21the Nursing Home Administrators Licensing and Disciplinary
22Act, the Illinois Occupational Therapy Practice Act, the
23Podiatric Medical Practice Act of 1987, the Respiratory Care

1Practice Act, the Professional Counselor and Clinical
2Professional Counselor Licensing and Practice Act, the
3Illinois Speech-Language Pathology and Audiology Practice Act,
4the Illinois Dental Practice Act, the Illinois Dental Practice
5Act, or the Behavior Analyst Licensing Act.
6    (b) For health care professional license or registration
7renewals occurring on or after January 1, 2025, a health care
8professional who has continuing education requirements must
9complete at least a one-hour course in training on cultural
10competency. A health care professional may count this one hour
11for completion of this course toward meeting the minimum
12credit hours required for continuing education.
13    (c) The Department may adopt rules for the implementation
14of this Section.

16    Sec. 2105-375. Limitation on specific statutorily mandated
17training requirements.
18    (a) As used in this Section:
19    "Health care professional" means a person licensed or
20registered by the Department under the following Acts: the
21Medical Practice Act of 1987, the Nurse Practice Act, the
22Clinical Psychologist Licensing Act, the Illinois Optometric
23Practice Act of 1987, the Illinois Physical Therapy Act, the
24Pharmacy Practice Act, the Physician Assistant Practice Act of

7the Illinois Dental Practice Act, the Illinois Dental Practice
8Act, or the Behavior Analyst Licensing Act.
9    "Statutorily mandated topics" means continuing education
10training as specified by statute, including, but not limited
11to, training required under Sections 2105-365 and 2105-370.
12    (b) Notwithstanding any other provision of law, for health
13care professional license or registration renewals occurring
14on or after January 1, 2025, a health care professional whose
15license or registration renewal occurs every 2 years must
16complete all statutorily mandated topics within 3 renewal
17periods. If any additional statutorily mandated topics are
18added by law after the effective date of this amendatory Act of
19the 103rd General Assembly, then a health care professional
20whose license or registration renewal occurs every 2 years
21must complete all statutorily mandated topics within 4 renewal
22periods.
23    (c) Notwithstanding any other provision of law, for health
24care professional license or registration renewals occurring
25on or after January 1, 2025, a health care professional whose
26license or registration renewal occurs every 3 years must

1complete all statutorily mandated topics within 2 renewal
2periods. If any additional statutorily mandated topics are
3added by law after the effective date of this amendatory Act of
4the 103rd General Assembly, then a health care professional
5whose license or registration renewal occurs every 3 years
6must complete all statutorily mandated topics within 3 renewal
7periods.
8    (d) Notwithstanding any other provision of this Section to
9the contrary, the implicit bias awareness training required
10under Section 2105-15.7 and the sexual harassment prevention
11training required under Section 2105-15.5 must be completed as
12provided by law.
13    (d-5) Notwithstanding any other provision of this Section
14to the contrary, the Alzheimer's disease and other dementias
15training required under Section 2105-365 must be completed
16prior to the end of the health care professional's first
17license renewal period, and thereafter in accordance with this
18Section.
19    (e) The Department shall maintain on its website
20information regarding the current requirements for the
21specific statutorily mandated topics.
22    (f) Each license or permit application or renewal form the
23Department provides to a health care professional must include
24a notification regarding the current specific statutorily
25mandated topics.

1    Section 10. The Illinois Controlled Substances Act is
2amended by changing Section 315.5 as follows:
 
3    (720 ILCS 570/315.5)
4    Sec. 315.5. Opioid education for prescribers. In
5accordance with the requirement for prescribers of controlled
6substances to undergo training under Section 1263 of the
7Consolidated Appropriations Act, 2023 (Public Law 117-328),
8every Every prescriber who is licensed to prescribe controlled
9substances shall, during the pre-renewal period, complete one
10hour 3 hours of continuing education on safe opioid
11prescribing practices offered or accredited by a professional
12association, State government agency, or federal government
13agency. Notwithstanding any individual licensing Act or
14administrative rule, a prescriber may count this hour these 3
15hours toward the total continuing education hours required for
16renewal of a professional license. Continuing education on
17safe opioid prescribing practices applied to meet any other
18State licensure requirement or professional accreditation or
19certification requirement may be used toward the requirement
20under this Section. The Department of Financial and
21Professional Regulation may adopt rules for the administration
22of this Section.

24    Section 99. Effective date. This Act takes effect January
251, 2025.
