2 | | AMENDMENT NO. ______. Amend House Bill 2817 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 1. Short title. This Act may be cited as the State |
5 | | Agency and Grantee Bonus Prohibition Act. |
6 | | Section 5. Definitions. As used in this Act: |
7 | | "Employee" means any person employed, full-time, |
8 | | part-time, or contractually, in any capacity by a State agency |
9 | | or hospital, without regard to whether that person's |
10 | | employment is subject to the advice and consent of the Senate |
11 | | or is for a stated term. "Employee" does not include persons |
12 | | subject to a collective bargaining agreement. |
13 | | "Grant funds" has the meaning provided in Section 2 of the |
14 | | Illinois Grant Funds Recovery Act. |
15 | | "Grantee" has the meaning provided in Section 2 of the |
16 | | Illinois Grant Funds Recovery Act. |

1 | | "Hospital" has the meaning provided in Section 3 of the |
2 | | Hospital Licensing Act. |
3 | | "State agency" has the meaning provided in Section |
4 | | 1-15.100 of the Illinois Procurement Code. |
5 | | Section 10. Bonuses prohibited. |
6 | | (a) No State agency or hospital shall pay from State |
7 | | funds, in whole or in part, and no employee of a State agency |
8 | | or hospital may receive a bonus as all or part of his or her |
9 | | compensation, including such bonuses as may be received for |
10 | | work on capital projects. |
11 | | (b) No grantee shall pay, and no employee or contract |
12 | | worker of a grantee may receive, a bonus paid from grant funds |
13 | | awarded for operational expenses as all or part of his or her |
14 | | compensation, including such bonuses as may be received for |
15 | | work on capital projects. |
16 | | (c) State agencies who use bonuses paid to State employees |
17 | | shall provide an annual report to the General Assembly |
18 | | itemizing each bonus awarded, including the amount of the |
19 | | bonuses awarded, the purpose of the bonus, the position of the |
20 | | employees to whom bonuses were awarded, and the overall agency |
21 | | fiscal impact for the bonuses awarded in the prior fiscal |
22 | | year. This report shall be due December 1, 2023 to the General |
23 | | Assembly and annually thereafter. Recruitment or retention |
24 | | bonuses for State employment shall be no more than $10,000 per |
25 | | bonus unless the Department of Central Management Services |
