1 | AMENDMENT TO HOUSE BILL 2822 | ||||||
2 | AMENDMENT NO. ______. Amend House Bill 2822 by replacing | ||||||
3 | everything after the enacting clause with the following: | ||||||
4 | "Section 5. The School Code is amended by adding Section | ||||||
5 | 2-3.204 as follows: | ||||||
6 | (105 ILCS 5/2-3.204 new) | ||||||
7 | Sec. 2-3.204. Supporting Newcomer Students Program. | ||||||
8 | (a) As used in this Section, "newcomer student" means a | ||||||
9 | student who is 3 years of age or older but below the age of 22 | ||||||
10 | years, who was born outside of the 50 states of the United | ||||||
11 | States, the District of Columbia, or the Commonwealth of | ||||||
12 | Puerto Rico, and who has been newly attending one or more | ||||||
13 | schools in any one or more states, the District of Columbia, or | ||||||
14 | the Commonwealth of Puerto Rico for less than 3 full school | ||||||
15 | years, regardless of immigration status. | ||||||
16 | (b) Subject to a specific State appropriation, the State |

1 | Board of Education shall implement and administer a Supporting | ||||||
2 | Newcomer Students Program to make funding available to a | ||||||
3 | school district to support the needs of newcomer students in | ||||||
4 | the school district. | ||||||
5 | (c) Subject to appropriation for the Program, the State | ||||||
6 | Board of Education shall annually disseminate a request for | ||||||
7 | applications to the Program, and funds shall be awarded | ||||||
8 | annually under the Program. In awarding funds under the | ||||||
9 | Program, the State Board of Education may consider (i) the | ||||||
10 | number of newcomer students enrolled in preschool, elementary | ||||||
11 | school, and secondary school within a school district, (ii) | ||||||
12 | the needs of newcomer students in a school district, and (iii) | ||||||
13 | the ability of a school district to meet the needs of newcomer | ||||||
14 | students. | ||||||
15 | (d) A school district organized under Article 34 of this | ||||||
16 | Code is eligible to receive no more than 30% of the funds | ||||||
17 | appropriated for the Program annually. | ||||||
18 | Section 99. Effective date. This Act takes effect July 1, | ||||||
19 | 2024.". |
