AMENDMENT TO HOUSE BILL 2823

2    AMENDMENT NO. ______. Amend House Bill 2823 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The University of Illinois Act is amended by
5changing Section 7e-5 as follows:
 
6    (110 ILCS 305/7e-5)
7    Sec. 7e-5. In-state tuition charge.
8    (a) Through the 2023-2024 academic year, notwithstanding
9Notwithstanding any other provision of law to the contrary,
10for tuition purposes, the Board of Trustees shall deem an
11individual an Illinois resident, until the individual
12establishes a residence outside of this State, if all of the
13following conditions are met:
14        (1) The individual resided with his or her parent or
15    guardian while attending a public or private high school
16    in this State.

1        (2) The individual graduated from a public or private
2    high school or received the equivalent of a high school
3    diploma in this State.
4        (3) The individual attended school in this State for
5    at least 3 years as of the date the individual graduated

8        (4) The individual registers as an entering student in
9    the University not earlier than the 2003 fall semester.
10        (5) In the case of an individual who is not a citizen
11    or a permanent resident of the United States, the
12    individual provides the University with an affidavit
13    stating that the individual will file an application to
14    become a permanent resident of the United States at the
15    earliest opportunity the individual is eligible to do so.
16    This subsection (a) applies only to tuition for a term or
17semester that begins on or after May 20, 2003 (the effective
18date of Public Act 93-7). Any revenue lost by the University in
19implementing this subsection (a) shall be absorbed by the
20University Income Fund.
21    (a-5) In the 2024-2025 academic year, and in every
22academic year thereafter, notwithstanding any other provision
23of law to the contrary, for tuition purposes, the Board of
24Trustees shall, at a minimum, deem an individual, other than
25an excluded non-immigrant alien, an Illinois resident, until
26the individual establishes a residence outside of this State,

1if all of the following conditions are met:
2        (1) The individual attended on campus and attained
3    credits at any of the following institutions in this
4    State:
5            (A) a public or private elementary school;
6            (B) a public or private high school;
7            (C) an adult education program funded by the
8        Community College Board under the Public Community
9        College Act; or
10            (D) a community college campus organized under the
11        Public Community College Act.
12        (2) The individual satisfies any of the following:
13            (A) the individual graduated from a public or
14        private high school or received the equivalent of a
15        high school diploma in this State;
16            (B) the individual attained an associate degree
17        from a community college campus organized under the
18        Public Community College Act; or
19            (C) the individual completed a General Education
20        Core Curriculum package under the Illinois
21        Articulation Initiative Act for students transferring
22        from a campus of a community college organized under
23        the Public Community College Act.
24        (3) The individual is a current student or registering
25    as an entering student in the University.
26        (4) The individual attests, if the individual is not a

2    States, that the individual will file an application to
3    become a permanent resident of the United States at the

8    As used in this subsection (a-5), "excluded non-immigrant
9alien" means any alien identified in subsection (a)(15)(F),
10(a)(15)(J), or (a)(15)(M) of Section 1101 of the Federal
11Immigration and Nationality Act (8 U.S.C. 1101 (a)(15)(F),
12(J), or (M)).
13    (b) If a person is on active military duty and stationed in
14Illinois, then the Board of Trustees shall deem that person
15and any of his or her dependents Illinois residents for
16tuition purposes. Beginning with the 2009-2010 academic year,
17if a person is on active military duty and is stationed out of
18State, but he or she was stationed in this State for at least 3
19years immediately prior to being reassigned out of State, then
20the Board of Trustees shall deem that person and any of his or
21her dependents Illinois residents for tuition purposes, as
22long as that person or his or her dependent (i) applies for
23admission to the University within 18 months of the person on
24active military duty being reassigned or (ii) remains
25continuously enrolled at the University. Beginning with the
262013-2014 academic year, if a person is utilizing benefits

1under the federal Post-9/11 Veterans Educational Assistance
2Act of 2008 or any subsequent variation of that Act, then the
3Board of Trustees shall deem that person an Illinois resident
4for tuition purposes. Beginning with the 2015-2016 academic
5year, if a person is utilizing benefits under the federal
6All-Volunteer Force Educational Assistance Program, then the
7Board of Trustees shall deem that person an Illinois resident
8for tuition purposes. Beginning with the 2019-2020 academic
9year, per the federal requirements for maintaining approval
10for veterans' education benefits under 38 U.S.C. 3679(c), if a
11person is on active military duty or is receiving veterans'
12education benefits, then the Board of Trustees shall deem that
13person an Illinois resident for tuition purposes for any
14academic quarter, semester, or term, as applicable.

17Act is amended by changing Section 8d-5 as follows:

23            (C) an adult education program funded by the
24        Community College Board under the Public Community
25        College Act; or

18    Section 50. The Higher Education Student Assistance Act is
19amended by changing Section 67 as follows:
 
20    (110 ILCS 947/67)
21    Sec. 67. Illinois DREAM Fund Commission.
22    (a) The Illinois Student Assistance Commission shall
23establish an Illinois DREAM Fund Commission. The Governor
24shall appoint, with the advice and consent of the Senate,

1members to the Illinois DREAM Fund Commission, which shall be
2comprised of 9 members representing the geographic and ethnic
3diversity of this State, including students, college and
4university administrators and faculty, and other individuals
5committed to advancing the educational opportunities of the
6children of immigrants.
7    (b) The Illinois DREAM Fund Commission is charged with all
8of the following responsibilities:
9        (1) Administering this Section and raising funds for
10    the Illinois DREAM Fund.
11        (2) Establishing a not-for-profit entity charged with
12    raising funds for the administration of this Section, any
13    educational or training programs the Commission is tasked
14    with administering, and funding scholarships to students
15    who are the children of immigrants to the United States.
16        (3) Publicizing the availability of scholarships from
17    the Illinois DREAM Fund.
18        (4) Selecting the recipients of scholarships funded
19    through the Illinois DREAM Fund.
20        (5) Researching issues pertaining to the availability
21    of assistance with the costs of higher education for the
22    children of immigrants and other issues regarding access
23    for and the performance of the children of immigrants
24    within higher education.
25        (6) Overseeing implementation of the other provisions
26    of this amendatory Act of the 97th General Assembly.

1        (7) Establishing and administering training programs
2    for high school counselors and counselors, admissions
3    officers, and financial aid officers of public
4    institutions of higher education. The training programs
5    shall instruct participants on the educational
6    opportunities available to college-bound students who are
7    the children of immigrants, including, but not limited to,
8    in-state tuition and scholarship programs. The Illinois
9    DREAM Fund Commission may also establish a public
10    awareness campaign regarding educational opportunities
11    available to college bound students who are the children
12    of immigrants.
13    The Illinois DREAM Fund Commission shall establish, by
14rule, procedures for accepting and evaluating applications for
15scholarships from the children of immigrants and issuing
16scholarships to selected student applicants.
17    (c) To receive a scholarship under this Section, a student
18must meet all of the following qualifications:
19        (1) (Blank). Have resided with his or her parents or
20    guardian while attending a public or private high school
21    in this State.
22        (2) (Blank). Have graduated from a public or private
23    high school or received the equivalent of a high school
24    diploma in this State.
25        (2.5) The individual satisfies any of the following:
26            (A) the individual graduated from a public or

2        high school diploma in this State;
3            (B) the individual attained an associate degree

22        Public Community College Act.
23        (4) Have at least one parent who immigrated to the
24    United States.
25    (d) The Illinois Student Assistance Commission shall
26establish an Illinois DREAM Fund to provide scholarships under
