| 2 | | Sec. 2. For the purposes of this Act:
|
| 3 | | "Arthropod" means a mosquito or other invertebrate animal |
| 4 | | with jointed
legs and a segmented body.
|
| 5 | | "Commercial pesticide applicator" means a person certified |
| 6 | | or licensed
under the Structural Pest Control Act or the |
| 7 | | Illinois Pesticide Act who
contracts to apply a pesticide |
| 8 | | within the scope of his or her certification
or license.
|
| 9 | | "Department" means the Illinois Department of Public |
| 10 | | Health.
|
| 11 | | "Director" means the Director of the Illinois Department |
| 12 | | of Public Health.
|
| 13 | | "Integrated pest management" means modification of the |
| 14 | | life system of a
vector or pest to reduce its numbers to an |
| 15 | | acceptable level by applying
current biological and |
| 16 | | technological knowledge to achieve the desired
modification in |
| 17 | | a manner that ensures protection of the environment and public |
| 18 | | health.
|
| 19 | | "Integrated vector management approach" means an approach |
| 20 | | that prioritizes prevention, biological, and nonchemical means |
| 21 | | of controlling disease vectors and prioritizes a data-driven |
| 22 | | approach to vector management. |
| 23 | | "Local health authority" means the full-time health |
| 24 | | department, as
recognized by the Department, having |
| 25 | | jurisdiction over a particular area.

| 26 | | "Pest" means undesirable arthropods (including certain |

| 1 | | insects, spiders,
mites, ticks and related organisms), wood |
| 2 | | infesting organisms, rats, mice,
birds and any other obnoxious |
| 3 | | or undesirable animals.

| 4 | | "Vector" means arthropods, rats, mice, birds or other |
| 5 | | animals capable of
carrying disease-producing organisms to a |
| 6 | | human or animal host. "Vector"
does not include animals that |
| 7 | | transmit disease to humans only when used as
human food.

| 10 | | Sec. 3.5. Integrated vector management plan; public |
| 11 | | notification prior to use of wide-area chemical pesticides |
| 12 | | from the public right of way. |
| 13 | | (a) An organization performing mosquito control as a |
| 14 | | public service shall submit to the Department a written |
| 15 | | integrated vector management plan. |
| 16 | | (b) This Section does not apply to the Department mosquito |
| 17 | | control grantees who are supervised by the Department on the |
| 18 | | effective date of this amendatory Act of the 103rd General |
| 19 | | Assembly. |
| 20 | | (c) This Section does not apply to any business or person |
| 21 | | regulated under the Structural Pest Control Act. |
| 22 | | (d) A vector management organization shall establish and |
| 23 | | maintain a system of public notification prior to the use of |
| 24 | | wide-area chemical pesticides from the public right of way. |
| 25 | | (e) A vector management plan shall consist of a plan for |
