3 | | line 4, after "by", by inserting "changing Section 2 and by"; |

5 | | on page 1, immediately below line 5, by inserting the |
6 | | following:

7 | | "(210 ILCS 40/2) (from Ch. 111 1/2, par. 4160-2)

8 | | Sec. 2. As used in this Act, unless the context otherwise |
9 | | requires:
|
10 | | "At-home continuing care" means an agreement to provide a |
11 | | person with services and supports based upon the person's |
12 | | needs and coordinated by a case manager, including services |
13 | | provided to the person in his or her residence and services of |
14 | | the community's affiliated facilities. |
15 | | "At-home continuing care resident" means an at-home |
16 | | continuing care agreement holder who resides in a private |

|
1 | | residence outside of the continuing care retirement community |
2 | | campus. |
3 | | (a) "Department" means the Department of Public Health.
|
4 | | (b) "Director" means the Director of the Department.
|
5 | | (c) "Life care contract" means a contract to provide to a |
6 | | person for the
duration of such person's life or for a term in |
7 | | excess of one year, nursing
services, medical services or |
8 | | personal care services, in addition to
maintenance
services |
9 | | for such person in a facility, conditioned upon the transfer |
10 | | of
an entrance fee to the provider of such services in addition |
11 | | to or in lieu
of the payment of regular periodic charges for |
12 | | the care and services involved.
|
13 | | (d) "Provider" means a person who provides services |
14 | | pursuant to a life care contract.
|
15 | | (e) "Resident" means a person who enters into a life care |
16 | | contract with
a provider, or who is designated in a life care |
17 | | contract to be a person provided
with maintenance and nursing, |
18 | | medical or personal care services.
|
19 | | (f) "Facility" means a place or places in which a provider |
20 | | undertakes
to provide a resident with nursing services, |
21 | | medical services or personal
care services, in addition to |
22 | | maintenance services for a term in excess of
one year or for |
23 | | life pursuant to a life care contract. The term also
means a |
24 | | place or places in which a provider undertakes to provide such
|
25 | | services to a non-resident.
|
26 | | (g) "Living unit" means an apartment, room or other area |

1 | | within a facility
set aside for the exclusive use of one or |
2 | | more identified residents.
|
3 | | (h) "Entrance fee" means an initial or deferred transfer |
4 | | to a provider
of a sum of money or property, made or promised |
5 | | to be made by a person entering
into a life care contract, |
6 | | which assures a resident of services pursuant
to a life care |
7 | | contract.
|
8 | | (i) "Permit" means a written authorization to enter into |
9 | | life care contracts
issued by the Department to a provider.
|
10 | | (j) "Medical services" means those services pertaining to |
11 | | medical or dental
care that are performed in behalf of |
12 | | patients at the direction of a physician
licensed under the |
13 | | Medical Practice Act of 1987 or a dentist licensed under the
|
14 | | Illinois Dental Practice Act by such physicians or dentists, |
15 | | or
by a registered or
licensed practical nurse as defined in |
16 | | the Nurse Practice Act
or by
other professional and technical |
17 | | personnel.
|
18 | | (k) "Nursing services" means those services pertaining to |
19 | | the curative,
restorative and preventive aspects of nursing |
20 | | care that are performed at
the direction of a physician |
21 | | licensed under the Medical Practice Act of 1987 by
or under the |
22 | | supervision of a registered or licensed practical nurse as
|
23 | | defined in the Nurse Practice Act.
|
24 | | (l) "Personal care services" means assistance with meals, |
25 | | dressing,
movement,
bathing or other personal needs or |
26 | | maintenance, or general supervision and
oversight of the |

1 | | physical and mental well-being of an individual, who is
|
2 | | incapable of maintaining a private, independent residence or |
3 | | who is incapable
of managing his person whether or not a |
4 | | guardian has been appointed for
such individual.
|
5 | | (m) "Maintenance services" means food, shelter and laundry |
6 | | services.
|
7 | | (n) "Certificates of Need" means those permits issued |
8 | | pursuant to the
Illinois Health Facilities Planning Act as now |
9 | | or hereafter amended.
|
10 | | (o) "Non-resident" means a person admitted to a facility |
11 | | who has not
entered into a life care contract.
