| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Equitable Restrooms Act is amended by |
| 5 | | changing Section 20 and by adding Section 30 as follows:
|
| 6 | | (410 ILCS 35/20) (from Ch. 111 1/2, par. 3751-20)
|
| 7 | | Sec. 20. Application. Except for Section 25 and Section |
| 8 | | 30, this Act applies only to places of public
accommodation |
| 9 | | that commence construction, or that commence alterations
|
| 10 | | exceeding 50% of the entire place of public accommodation, |
| 11 | | after the
effective date of this Act.
|

| 14 | | Sec. 30. Menstrual hygiene products in public restrooms. |
| 15 | | (a) The General Assembly finds that: |
|

| 1 | | (1) menstrual hygiene products are a health care |
| 2 | | necessity
and not an item that can be forgone or |
| 3 | | substituted
easily; and |
| 4 | | (2) access to menstrual hygiene products is a serious |
| 5 | | and
ongoing need in this State. |
| 6 | | (b) As used in this Section: |
| 7 | | "Menstrual hygiene products" means tampons and sanitary
|
| 8 | | napkins for use in connection with the menstrual cycle. |
| 9 | | "Public restroom" means any public toilet facility that is |
| 10 | | available without preference to any specific gender or any |
| 11 | | public toilet facility that is available only to women. |
| 12 | | "Public restroom" does not include any public toilet facility |
| 13 | | in a mosque, temple, church, and other places of worship if
the |
| 14 | | provision of menstrual hygiene products would conflict with |
| 15 | | the entity's
sincerely held religious beliefs, practices, or |
| 16 | | observances. |
| 17 | | (c) This Section applies to any existing or future public |
| 18 | | buildings, as that term is defined in Section
18. |
| 19 | | (d) Notwithstanding any other provision of law, the owner |
| 20 | | of a public restroom shall make available and accessible in |
| 21 | | that public restroom menstrual hygiene products at no cost and |
| 22 | | shall be
responsible for ordering, stocking, and replenishing |
| 23 | | the supply
of those products in that restroom. This subsection |
| 24 | | does not apply to the Department of Natural Resources, which, |
| 25 | | subject to appropriation, may establish a pilot program to |
| 26 | | make menstrual hygiene products available, at no cost to the |

| 1 | | public, in each public restroom that is equipped with flush |
| 2 | | toilets and serviced daily at 5 State parks under the |
| 3 | | jurisdiction and control of the Department of Natural |
| 4 | | Resources. |
| 5 | | (e) During any inspection of a public building by a health |
| 6 | | officer or health inspector, the
health officer or health |
| 7 | | inspector may inspect the public building to determine whether |
| 8 | | it
complies with this Section. |
| 9 | | (f) The Department of Public Health shall adopt rules to
|
| 10 | | implement this Section.
|
| 11 | | Section 99. Effective date. This Act takes effect upon |
| 12 | | becoming law.".
