| 1 | | AN ACT concerning animals.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Humane Care for Animals Act is amended by |
| 5 | | changing Section 4 as follows:
|
| 6 | | (510 ILCS 70/4) (from Ch. 8, par. 704)
|
| 7 | | Sec. 4. Prohibited acts. No person may sell, offer for |
| 8 | | sale, barter,
or give away as a pet or a novelty any rabbit,
|
| 9 | | hermit crab, goldfish, or any baby chick, duckling or
other |
| 10 | | fowl which has been dyed, colored, or otherwise treated to |
| 11 | | impart an
artificial color thereto. Baby chicks or ducklings |
| 12 | | shall not be sold, offered
for sale, bartered, or given away as |
| 13 | | pets or novelties. Rabbits, ducklings
or baby chicks shall not |
| 14 | | be awarded as prizes.

| 15 | | No person may allow for the adoption, transfer, sale, |
| 16 | | offer for sale, barter, or give away any animal forfeited or |
| 17 | | relinquished under Section 3.04 or 3.05 of this Act to the |
| 18 | | person who forfeited the animal or a person residing in that |
| 19 | | person's household. |
| 20 | | A person convicted of violating this Section is guilty of |
| 21 | | a Class B
misdemeanor. A second or subsequent violation is a |
| 22 | | Class 4 felony, with
every day that a violation continues |
| 23 | | constituting a separate offense.
