2 | | AMENDMENT NO. ______. Amend House Bill 3337 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. If and only if Senate Bill 208 of the 102nd |
5 | | General Assembly becomes law, then the Paid Leave for All |
6 | | Workers Act is amended by changing Section 10 as follows: |

8 | | Sec. 10. Definitions. As used in this Act: |
9 | | "Construction industry" means any constructing, altering, |
10 | | reconstructing, repairing, rehabilitating, refinishing, |
11 | | refurbishing, remodeling, remediating, renovating, custom |
12 | | fabricating, maintenance, landscaping, improving, wrecking, |
13 | | painting, decorating, demolishing, or adding to or subtracting |
14 | | from any building, structure, highway, roadway, street, |
15 | | bridge, alley, sewer, ditch, sewage disposal plant, |
16 | | waterworks, parking facility, railroad, excavation or other |

1 | | structure, project, development, real property, or |
2 | | improvement, or to do any part thereof, whether or not the |
3 | | performance of the work herein described involves the addition |
4 | | to or fabrication into, any structure, project, development, |
5 | | real property, or improvement herein described of any material |
6 | | or article of merchandise. |
7 | | "Construction industry" also includes moving construction |
8 | | related materials on the job site or to or from the job site, |
9 | | snow plowing, snow removal, and refuse collection. |
10 | | "Department" means the Illinois Department of Labor. |
11 | | "Domestic work" and "domestic worker" have the same |
12 | | meanings as defined in Section 10 of the Domestic Workers' |
13 | | Bill of Rights Act, except that "domestic worker" also |
14 | | includes independent contractors, sole proprietors, and |
15 | | partnerships. |
16 | | "Employee" has the same application and meaning as that |
17 | | provided in Sections 1 and 2 of the Illinois Wage Payment and |
18 | | Collection Act. "Employee" also includes all domestic workers, |
19 | | and, for the purposes of this Act, domestic workers shall not |
20 | | be excluded as employees under the provisions of item (1), |
21 | | (2), or (3) of Section 2 of the Illinois Wage Payment and |
22 | | Collection Act. "Employee" does not include: |
23 | | (1) an employee as defined in the federal Railroad |
24 | | Unemployment Insurance Act (45 U.S.C. 351 et seq.) or the |
25 | | Railway Labor Act; |
26 | | (2) a student enrolled in and regularly attending |

1 | | classes in a college or university that is also the |
2 | | student's employer, and who is employed on a temporary |
3 | | basis at less than full time at the college or university, |
4 | | but this exclusion applies only to work performed for that |
5 | | college or university; or |
6 | | (3) a short-term employee who is employed by an |
7 | | institution of higher education for less than 2 |
8 | | consecutive calendar quarters during a calendar year and |
9 | | who does not have a reasonable expectation that they will |
10 | | be rehired by the same employer of the same service in a |
11 | | subsequent calendar year. |
12 | | "Employer" has the same application and meaning as that |
13 | | provided in Sections 1 and 2 of the Illinois Wage Payment and |
14 | | Collection Act, except that for purposes of this Act, |
15 | | "employer" also means the State and units of local government, |
16 | | any political subdivision of the State or units of local |
17 | | government, or any State or local government agency. |
18 | | "Employer" does not include school districts organized |
19 | | under the School Code , or park districts organized under the |
20 | | Park District Code , or departments of a municipality that |
21 | | operate parks and recreation facilities and programs . |
22 | | "Writing" or "written" means a printed or printable |
23 | | communication in physical or electronic format, including a |
24 | | communication that is transmitted through electronic mail, |
25 | | text message, or a computer system or is otherwise sent or |
26 | | stored electronically.

2 | | Section 10. The Illinois Municipal Code is amended by |
3 | | changing Section 3.1-25-95 and by adding Section 5-2-20 as |
4 | | follows:

6 | | Sec. 3.1-25-95. Incorporated town officers. |
7 | | (a) For each the general municipal
election in the Town of |
8 | | Cicero, to be held
in the year 1985 in every incorporated town |
9 | | with a population
of 25,000 or more by the last official |
10 | | census, and every 4 years thereafter,
the municipal clerk |
11 | | shall certify the names of the candidates
to the proper |
12 | | election authority as provided by the general election
law. A |
13 | | president, a clerk, an assessor, a
collector, and a supervisor |
14 | | shall be elected for a term of 4 years
and until their |
15 | | successors are elected
and have qualified. Whenever a vacancy |
16 | | occurs in the office of any of the
specified officers, the |
17 | | vacancy shall
be filled for the remainder of the term at the |
18 | | next general municipal election
in that incorporated town as |
19 | | provided in Section 3.1-10-50. Whenever an
election is held |
20 | | for this purpose, the municipal clerk shall certify the
office |
21 | | to be filled and the candidates for that office to the election

22 | | authorities
as provided in the general election law. During |
23 | | the period from the time
a vacancy occurs until a clerk, |
24 | | assessor, collector, or supervisor is elected
and has |

1 | | qualified, the vacancy may be filled by appointment by the |
2 | | president
and board of trustees of that incorporated town |
3 | | voting jointly. During the
period from the time a vacancy |
4 | | occurs until a president is elected and has
qualified, the |
5 | | vacancy may be filled by appointment by the board of trustees
|
6 | | of that incorporated town. |
7 | | (b) For every other incorporated town other than the Town |
8 | | of Cicero with a population of 25,000 or more by the last |
9 | | decennial census, a president must be elected every 4 years at |
10 | | the general municipal election with other officers to be |
11 | | elected or appointed as set forth by ordinance of the |
12 | | corporate authorities. Each officer shall continue to hold |
13 | | office until the officer's successor is selected and |
14 | | qualified. Each vacancy must be filled under Section |
15 | | 3.1-10-50.

16 | | (c) The changes made to subsection (a) by this amendatory |
17 | | Act of the 103rd General Assembly are declarative of existing |
18 | | law and shall be applied retroactively when substantively |
19 | | applicable, including all pending actions without regard to |
20 | | when the cause of action accrued. |

6 | | Section 99. Effective date. This Act takes effect upon |
7 | | becoming law, except that Section 5 takes effect upon becoming |
8 | | law or on the date Senate Bill 208 of the 102nd General |
9 | | Assembly takes effect, whichever is later.".
