| 12 | | Sec. 3. Purpose. This Act is intended to provide time off |
| 13 | | with pay to allow employees of units of local government, |
| 14 | | boards of election commissioners, or private employers in the |
| 15 | | State of Illinois to donate blood, an organ, or bone marrow.

|
| 3 | | Sec. 5. Definitions. As used in this Act: |
| 4 | | "Employer" means any unit of local government, board of |
| 5 | | election commissioners, or any private employer in the State |
| 6 | | who has 51 or more employees.
|
| 7 | | "Department" means the Department of Public Health.
|
| 8 | | "Organ" means any biological tissue of the human body that |
| 9 | | may be donated by a living donor, including, but not limited |
| 10 | | to, the kidney, liver, lung, pancreas, intestine, bone, and |
| 11 | | skin or any subpart thereof. |
| 12 | | "Participating employee" means a full-time employee who |
| 13 | | has been employed by an employer for a period of 6 months or |
| 14 | | more and who donates blood, an organ, or bone marrow.

| 17 | | Sec. 10. Paid leave for blood donation; administration. |
| 18 | | (a) On request, a participating employee subject to this |
| 19 | | Act may be
entitled to blood donation leave with pay to donate |
| 20 | | blood, an organ, or bone marrow. |
| 21 | | (b) An employee may use
up to one hour, or more if |
| 22 | | authorized by the employer or a collective bargaining |
| 23 | | agreement, to donate blood every 56 days in accordance with |
| 24 | | appropriate medical standards
established by the American Red |

| 1 | | Cross, America's Blood Centers, the American Association of |
| 2 | | Blood Banks, or other nationally recognized standards. |
| 3 | | (b-5) An employee may use up to 10 days of leave in any |
| 4 | | 12-month period to serve as an organ donor. |
| 5 | | (b-10) An employee may use up to 5 days of leave in any |
| 6 | | 12-month period to serve as a bone marrow donor. |
| 7 | | (c) A participating employee may use the leave authorized |
| 8 | | in
subsection (b), (b-5), or (b-10) of this Section only after |
| 9 | | obtaining approval
from the employer.

| 10 | | (d) The Department must adopt rules governing blood |
| 11 | | donation leave taken to donate blood, an organ, or bone |
| 12 | | marrow,
including rules that (i) establish conditions and |
| 13 | | procedures for requesting
and approving leave and (ii) require |
| 14 | | medical documentation of the proposed
blood, organ, or bone |
| 15 | | marrow donation before leave is approved by the employer.
